Abstract:

Bakalářská práce se zabývá nabytím vlastnického práva k nemovitosti. Kromě úvodu a závěru je práce rozdělena do sedmi kapitol. Jednotlivé kapitoly jsou rozdělené na podkapitoly. První kapitola vymezuje pojmy, vlastnické pojmy, spoluvlastnictví, přídatné spoluvlastnictví, společné jmění manželů a pojem nemovitost. Kapitola druhá popisuje exkurz do historie zkoumaného předmětu. Zaměřuje se na historii od římských pramenů po současné právní předpisy. Kapitola třetí popisuje jednotlivé právní prameny, kterými jsou mezinárodní, unijní a vnitrostátními. Další kapitola se zabývá právními zásadami vztahující se k nabývání vlastnického práva. Předmětem zkoumání bude zejména zásada materiální a formální publicity, zásada dobré víry a autonomie vůle. Pátá kapitola se zabývá způsoby nabývání vlastnického práva, rozdíl mezi originární a derivativní způsoby nabývání vlastnického práva. Jsou popsány pouze vybrané způsoby nabývání. V šesté kapitole bude věnována pozornost katastru nemovitostí, jaké jsou druhy zápisu do katastru nemovitosti, jakými je vklad, zápis nebo poznámka. Kapitola sedm je věnována daňové problematice. Tato kapitola se zabývá daní z nemovitosti a daní darovací, budou zmíněné i zrušené daně, jako je daň z převodu pozemků a dědická daň. V praktické části této práce byla na základě teoretických poznatků použita kupní smlouva a byl učiněn komentovaný návrh na vklad do katastru nemovitostí.

Abstract:

The bachelor thesis deals with the acquisition of the ownership right to real estate. Apart from the introduction and conclusion, the thesis is divided into seven chapters. The individual chapters are divided into subchapters. The first chapter defines the terms, ownership, co-ownership, accessory co-ownership, community of property, and the concept of real estate. Chapter Two describes an excursion into the history of the subject under study. It focuses on the history from Roman sources to contemporary legislation. Chapter Three describes the different sources of law, which are international, EU, and national. The next chapter deals with the legal principles relating to the acquisition of property rights. In particular, the principles of material and formal publicity, good faith, and autonomy will be examined. The fifth chapter deals with the methods of acquisition of title, and the difference between original and derivative methods of acquisition of title. Only selected methods of acquisition are described. The sixth chapter will focus on the land registry, what are the types of registration in the land registry, such as deposit, registration, or remark. Chapter Seven is devoted to tax issues. This chapter deals with the estate tax and gift tax and abolished taxes such as land transfer tax and inheritance tax will also be mentioned. In the practical part of this thesis, based on the theoretical knowledge, a purchase contract was used and an annotated proposal for entry into the Land Registry was made.
