Violation of the Prohibition of Cartel Agreements and the Prohibition of Abuse of Dominance in single-acting Concurrence

Abstract:

Diplomová práce se zabývá problematikou z oblasti ochrany hospodářské soutěže, a to jednočinným souběhem porušení zákazu kartelových dohod a zákazu zneužití dominantního postavení. Práce se zaměřuje na nejdůležitější aspekty této problematiky, kterými jsou podstata jednotlivých zákazů, jejich komparace a vymezení vzájemného vztahu, zvážení možnosti paralelní aplikace obou ustanovení na protisoutěžní jednání a otázka následného postihu. Tyto otázky jsou řešeny jak z hlediska teoretické úpravy, tak i z hlediska vývoje judikatury, a to v rovině české i unijní úpravy. Práce se také zabývá zvážením možnosti aplikace zásady ne bis in idem. Text práce je založen především na komparativní a analytické metodě a představuje v mezích rozsahu práce komplexní pohled na problematiku, která v teorii ani praxi není doposud zcela objasněná.

Abstract:

The thesis deals with the problems in the field of the protection of the competition law; in particular, it studies the singe-acting concurrence violation of the cartel agreements and a prohibition of the abuse of dominant position. The thesis focuses on the most important aspects of this topic, which are: The nature of the individual prohibitions, their comparison and a definition of their mutual relationship, consideration of the possibility of a parallel application of both regulations for anticompetitive acting and the question of a subsequent sanction. These questions are approached from the theoretical adjustment as well as the judicature history point of view, in the context of Czech and EU´s adjustment. The thesis also considers the usage of the ne bis in idem principal. The thesis is mainly based on a comparative and analytical method and introduces, within the restriction of the content, a complex view on this issue, that has not been clarified theoretically or in practice till yet.
