Preliminary injunction

Abstract:

Cílem diplomové práce je analyzovat institut předběžného opatření a navrhnout, jak by se dala řešit problematická ustanovení, která jsou s tímto institutem spjatá. V úvodu je pojednáno o základních principech předběžného opatření. První kapitola popisuje historický vývoj. Dále navazuje část, která se týká současné právní úpravy. Je zde pojednáno o řízení o návrhu na předběžné opatření, jakým způsobem se zahajuje řízení, co musí obsahovat návrh, jakým způsobem se postupuje. Je zde věnována pozornost i velmi diskutovanému institutu jistoty. V práci je také začleněno stručné pojednání o zvláštních předběžných opatření. Na konci této části je uvažováno nad novým institutem žaloby z rušené držby a jeho vztahu k úpravě předběžných opatření. Třetí část se zabývá srovnáním se Slovenskou právní úpravou. Následující část obsahuje úvahy de lege ferenda. V závěru je pak uvedeno zhodnocení současné právní úpravy a shrnutí problematických ustanovení.

Abstract:

The main aim of this thesis is to analyze the legal concept of preliminary injunction and to suggest on how to deal with the problematic provisions associated trehewith. In the introduction, the essential principles of preliminary injunction are inquired into. The first chapter gives an account of the history of preliminary injunction. Further on is the part of the thesis that pertains to the legal regulation currently in force. Outlined herein is the legal proceeding on the motion for eliminary injunction, how to initiate such a proceeding, the minimum contents of such a motion and how such a proceeding evolves over time. Some attention is also focused on the hot topic of security and included is a brief overview of various types of preliminary injunctions. At the end of this part, the new legal concept of actions for protection from disturbed possession is debated and its relation to the legal regulation of preliminary injunction. The third part is dedicated to a comparison with the Slovak legal regulation. The subsequent part contains thought on how to deal with the issue at hand de lege ferenda. Lastly follows a review of the current legal regulation and a summary of the problematic legal provisions.
