Harmonization vs. unification of Law - Real Practice and Perspective

Abstract:

Tato práce pojednává o dvou hlavních metodách aproximace práva členských států Evropské unie, a to harmonizaci a unifikaci, jejichž význam spočívá především v tom, že umožňují dosáhnout cílů unií stanovených, čímž zajišťují její řádné fungování. Cílem je poskytnout informace o obou jmenovaných metodách a tyto vzájemně porovnat. Práce obsahuje charakteristiku a historický vývoj jednotlivých metod, zaměřuje se na jejich členění a prostředky užívané při sbližování a sjednocování práva. Pozornost je dále věnována jejich zakotvení v primárním právu unie, vymezení oblastí, v nichž se ta či ona metoda používá, a zamyšlení se nad otázkou, zda by bylo možné v takto stanovených oblastech metody vzájemně zaměnit. V neposlední řadě se práce zabývá výhodami a nevýhodami obou metod, jejich slabinami, možnostmi překonání takových slabin a možným vývojem obou metod v budoucnu.

Abstract:

This diploma thesis deals with two major approximation methods of the laws of the European Union Member States, namely harmonization and unification. The importance consists primarily in enabling the achievement of objectives set by the Union, thus ensuring its proper functioning. The aim is to provide information about these named methods and compare these with each other. The thesis contains characteristics and historical developments of individual methods, focusing on their structure and the means, which are used in the process of harmonization and unification of the laws. Attention is also paid to their inclusion in the Union's primary law, to the demarcation of areas in which they are used, and to the consideration of the question whether it would be possible to mutually swap them in these areas. Finally, the thesis deals with the advantages and disadvantages of both methods, with their weaknesses and the possibilities of overcoming such weaknesses, and with the potential development of both methods in the future.
