Interrogation of The accused as a means of proof in criminal law

Abstract:

Annotation When processing the present work by studying the relevant laws and appropriate literature, we think that currently applicable rules of the field meet the current requirements on the conduct of the criminal proceedings and adequately protect the interests of society. However, it is clear that in the process of inquiry and criminal proceedings, regardless of compliance with procedural rules, a variety of factors enter, having a negative impact on the conduct of the proceedings, and in some cases on its outcome. Hence, we see the need to ensure adequate staffing and technical aspects of implementing part of the process of inquiry.

Abstract:

Anotácia Pri spracovaní predloženej práce štúdiom príslušných právnych predpisov a náležitej literatúry sme dospeli k názoru, že v súčasnosti platná právna úprava skúmanej problematiky, vyhovuje aktuálnym požiadavkám kladeným na priebeh celého trestného konania a adekvátnym spôsobom chráni záujmy spoločnosti. Je však zrejmé, že do priebehu procesu dokazovania a trestného konania, bez ohľadu na dodržiavanie procesných postupov, vstupujú rôznorodé okolnosti majúce negatívny vplyv na priebeh konania, a v niektorých prípadoch i na jeho výsledok. Z tohto dôvodu vidíme potrebu adekvátneho zabezpečenia personálnej i technickej stránky jednotlivých súčasti realizujúcich proces dokazovania.
