The Crisis of Legitimacy of Law

Abstract:

Tato práce se zaměřuje se na analýzu krize legitimity práva a zejména jejích příčin na pozadí „soumraku moderního státu“. Zabývá se nejobecnějšími důvody tohoto procesu v oblasti noetiky, axiologie i ontologie. Příčiny této krize identifikuje v posunech evropského myšlení, ke kterým došlo prosazením se nonkognitivisticko-nominalistického paradigmatu. Přijetím těchto východisek veškerá normativita i legitimita práva ztrácí oporu v realitě a nutně se musí jevit jako fikce. Autor se ztotožňuje s názorem mnohých (mj. i Alexyho či Böckenfördeho), že bez zakotvení práva, resp. jeho nejdůležitějších složek, jako jsou lidská práva, v metafyzickém základu, nelze konzistentně odůvodnit jejich univerzální nárok ani legitimitu. Východisko je spatřováno v umírněném tomistickém přístupu, který na jedné straně umožňuje vymezení rámce pro pozitivněprávní normotvorbu při zachování základních limitů i zacílení práva na obecné dobro a na druhé straně zachování politické svobody.

Abstract:

This work focuses on the analysis of the crisis of legitimacy of law and, in particular, its causes on the background of the "twilight of the modern state". It deals with the most general reasons for this process in the field of noetics, axiology and ontology. The causes of this crisis are reflected in the shifts of Western thought due to the change of paradigm into the noncognitivist-nominalistic one. By accepting these foundations, all the normality and legitimacy of law loses the contact with reality and must appear as fiction. The author agrees with the opinion of many (including Alexy and Böckenförde) who stand for the attitude that law, mainly its most important components such as human rights, must be rooted in the metaphysical basis because it is the only way how their universal claim and legitimacy of law can be consistently justified. The solution is seen in the moderate Thomistic approach, whichallows the definition of a framework for positive lawmaking while preserving the basic limits and the aiming of law at the common good and on the one hand, and the preservation of political freedom on the other hand.
