The Competition Policy of the European Union in Cases of Abuse of Dominant Position

Abstract:

Tato bakalářská práce je zaměřena na problematiku dominantního postavení mezinárodních firem na vnitřním trhu Evropské unie. Hlavním cílem práce je na základě teoretických poznatků, a následně rozboru různých případů týkajících se dominantního postavení a jeho zneužití, zanalyzovat dopady aplikace soutěžní politiky Evropské unie na spotřebitele a mezinárodní společnosti činné na jednotném trhu, a to se zaměřením na odvětví informačních technologií. V první kapitole dochází k teoretické deskripci soutěžní politiky Evropské unie s důrazem na dominantní postavení, a to jak z ekonomického, tak i z právního hlediska. Druhá kapitola je věnována analýze a rozboru tří případů vztahujících se k dominantnímu postavení a jeho zneužití z oblasti informačních technologií. Třetí část bakalářské práce pak přináší porovnání analyzovaných případů a zhodnocení důsledků aplikace soutěžní politiky v těchto případech z pohledu spotřebitele i mezinárodních firem. Taktéž zde dochází ke zobecnění těchto poznatků a predikování možného budoucího vývoje aplikace soutěžní politiky Evropské unie ve sféře informačních technologií.

Abstract:

This bachelor thesis is aimed at the problematics of dominant position of international companies on the common market of the European Union. The main aim of this bachelor thesis is the analysis of the application of the competition policy of the European Union in cases of dominant position and its abuse in the information technology sector and then the appraisal of consequences for consumers and international companies. The first chapter provides the economic and legal description of the competition policy of the European Union with emphasis on dominant position. The second chapter focuses on the analysis of three cases related to dominant position and its abuse. The third chapter brings the comparison of analysed cases and the appraisal of consequences for consumers and international companies. The findings are also generalized and a possible future development of the competition policy of the European Union in the information technology sector is predicted.
