Alternative Resolutions to Family Law Conflicts

Abstract:

Kvantitativní, institucionální a kompetenční expanze justice (justičních systémů) v 19. a 20. století, v důsledku ústupu vlivu mimoprávních normativních systémů (především náboženství, morálky a tradičního modelu rodiny), vedla k přetíženosti soudů, nepřiměřené délce, procesnímu formalismu a nákladnosti soudního řízení v celé Evropě – obdobně jako v ostatních částech světa. Veřejnost ztrácí důvěru v justici a projevuje ve zvýšené míře nespokojenost s fungováním soudního systému. Jedním z pokusů řešit tento neutěšený stav je renesance alternativního, „přátelského“ řešení sporů („ADR“) – částečný návrat k „procesnímu přirozenému právu“. Přetíženost soudů, nákladnost a formálnost soudního řízení, jsou rozhodujícími faktory vedoucími k rozvoji alternativního řešení sporů/konfliktů, inter alia, mediace. Disertační práce se zabývá vývojem rodinného soužití, východisky a určovateli řešení rodinněprávních konfliktů a možnostmi jejich řešení smírnou, „přátelskou“ formou dle stavu de lege lata, ústícími v úvahy de lege ferenda. Zpřístupňuje vymahatelnost práva v rodinných věcech v rámci soudního a mimosoudního systému, za jejich vzájemné návaznosti – zamezení promlčení práva a dosažení exekučního titulu na základě uzavřené mediační dohody. Je zdůrazňován zájem dítěte ve vnitrostátních i přeshraničních věcech. Práce poukazuje na přínos a možná úskalí rodinné mediace.

Abstract:

As a result of withdrawal of non legal normative systems such as religion, morality and traditional family model, the 19th and 20th centuries justice systems expanded in terms of quantity, institutions and competency which consequently led to overload of courts, lengthy procedures, legal formalism and inadequate litigation costs all over Europe, alike in other parts of the world. Public confidence in justice has decreased and dissatisfaction over the effectivity of the legal system has increased. One of the attempt to deal with the loss of reputation has been the idea of alternative (amicable) dispute resolution („ADR“) as a partial renaissance of “natural procedural law“. The workload of courts, litigation expenses and legal formalism have been determining factors leading to the significant development and growth of alternative dispute resolutions, inter alia, the mediation. The dissertation looks into the development of family living together, starting points of family disputes, proposals of resolution and the options available for resolution in an amicable way according to the state de lege lata, leading to the reasoning de lege ferenda. The dissertation presents the legal framework providing access to justice within or outside judicial proceedings and shows how they are interconnected in the family law conflicts – limitation of action concerning mediation and the acquisition a executory title resulting from a mediation. In the national and cross-border cases the interest of the child must primarily be taken into account. The work also points out advantages and possible disadvantages of family mediation.
