European Commission's Consultation Regimes and Positions of Interest Groups on Public Consultations

Abstract:

Předložená práce se zaměřuje na veřejnou konzultační praxi Komise a zasazení veřejných (elektronických) konzultací do širšího kontextu konzultačních režimů vyvíjených Komisí. Pomocný nástroj představuje typologie konzultačních režimů, kterou autorka vytvořila po zohlednění míry formalizace a inkluzivity jednotlivých typů konzultací. Veřejné (elektronické) konzultace jsou přitom zkoumány na základě analýzy postojů Komise a požadavků 62 vybraných zájmových skupin týkajících se konzultační praxe. Zmíněné požadavky byly zájmovými skupinami předloženy ve veřejných konzultacích v letech 2002–2014. Na základě provedené analýzy práce předkládá oblasti souladu a rozporů v otázce nastavení veřejných konzultací mezi Komisí a zájmovými skupinami i mezi kategoriemi zájmů. Dlouhodobá shoda na tom, jak inkluzivní by konzultační politika Komise měla být a podle jakých pravidel by se měla odehrávat, je přitom velmi důležitá pro motivaci klíčových zájmových aktérů opakovaně se zapojovat do tvorby evropských politik. Má tedy dalekosáhlé dopady na vnímání legitimity a demokratické povahy těchto politik.

Abstract:

The thesis focuses on the public consultation practice of the European Commission and the placement of public (online) consultations within the wider context of consultation regimes developed by the Commission. As a supportive tool in the research, a consultation regime typology was formed by the author after taking into account the levels of formalization and inclusion of individual consultation types. Public (online) consultations are examined on the basis of the Commission approach analysis and 62 selected interest groups' requests regarding consultation practice. The above mentioned requests were submitted in public consultations by the interest groups between the years 2002 and 2014. Based on the analysis, the thesis presents areas of accordance as well as contradiction in the question of setting of public consultation between the Commission and interest groups and between categories of interests. Long-term agreement regarding the desired level of inclusion of the Commission's consultation policy and the rules it should abide is of highest importance for the motivation of key interest agents to be repeatedly involved in the making of European policies. The agreement has therefore far reaching impact on the perception of the legitimacy and democratic character of these policies.
