Hereditary succession

Abstract:

Diplomová práce se zabývá tématem dědické posloupnosti a klade si za cíl popsat právní úpravu týkající se dědické posloupnosti. Čtenář se nejprve seznámí se základními pojmy dědického práva, kterými je zahájen vhled do první části práce. V této části práce jsou následně stručně popsány předpoklady dědické posloupnosti, které jsou důležité pro samotný vznik dědictví. Těmito předpoklady pro vznik dědického práva jsou smrt zůstavitele, způsobilý dědic, existence jmění v době smrti zůstavitele a dědický titul. Druhá část práce se poté zabývá jednotlivými dědickými tituly, jejich současnou právní úpravou a srovnává je s předchozí právní úpravou. Těmito dědickými tituly jsou dědická smlouva, závěť a zákonná dědická posloupnost. Abstract:

The thesis deals with the topic of hereditary succession and aims to describe the legal regulations concerning succession.The reader is introduced to the basic terms of the law of succession, which starts the insight into the first part of the work. This part of the work then briefly describes the prerequisites of the hereditary succession, which are important for the actual creation of the succession. These prerequisites for the creation of the law of succession are the death of the testator, a qualified heir, the existence of assets at the time of the death of the testator and the title of succession. The second part of the thesis then deals with individual succession titles, their current legal regulation and compares them with the previous legal regulation. These succession titles are the contract of succession, the will and the legal succession.
