Framework Agreements and their Recommended Content

Abstract:

Tato bakalářská práce se věnuje otázkám týkajících se tématu rámcových smluv a jejich náležitostí. V úvodu je představen pojem rámcová smlouva. Součástí je práv-ní pohled doktríny a judikatury. Hlavní část práce se věnuje typickým náležitostem rámcových smluv. Rozebrány jsou základní smluvní instituty. Zároveň tato část slouží jako pomůcka při sestavování rámcové smlouvy. Poslední třetí část obsahuje některá doporučená ustanovení. Jednotlivá doporučení jsou rozdělena podle smluvních stran s výhodami pro kupujícího nebo prodávajícího.

Abstract:

This bachelor thesis is dedicated to questions dealing with issues related to the topic of framework agreement and its requirements. At the beginning a framework agreement term is introduced. Legal view of doctrine and jurisprudence is a part of it. The main part of the thesis focused on the typical requirements of framework agreements and the basic contractual institutes are analysed. It is also aimed for use as a legal aid in the preparation of a framework agreement. The last part of this thesis contains some of the recommended provisions. The Individual recommendations are divided between the contracting parties with advantages either for the buyer or the seller.
