Reconstruction of violent crimes

Abstract:

Předmětem mé závěrečné práce je detailní rozebrání problematiky kriminalistické rekonstrukce násilných trestných činů. Kriminalistická rekonstrukce je jedním ze zvláštních způsobů dokazování a je o ní pojednáváno i v trestním řádu České republiky. Konkrétně v hlavě páté, oddíle třetím. Dále jsou zde obsaženy i jiné způsoby dokazování, jako je rekognice, konfrontace, prověrka na místě a vyšetřovací pokus. Všechny tyto způsoby dokazování umožňují detailní prověřování získaných důkazů v trestním řízení o konkrétní věci, popřípadě nám napomáhají i získání důkazů nových. V mé práci se zaměřuji také na komparaci právní úpravy kriminalistické rekonstrukce v jiných zemích a na vymezení podobností a odlišností s vyšetřovacím pokusem. Toto téma jsem si vybrala z důvodu toho, že si myslím, že by mělo být více rozebíráno a řešeno v kruzích Policie ČR. Především řešit určitou modernizaci provedení, či jiných způsobů, jež by mohly usnadnit práci policistům. Proto jsem ve své práci zmínila i počítačovou 3D metodu, která u nás ještě není tolik rozšířena a soudem akceptována, ale časem by mohla být jednou z dílčích částí kriminalistické dokumentace. Cílem mé práce je rozbor pojmu a významu kriminalistické rekonstrukce, dále pak rozebrání jejích druhů, jako je například rekonstrukce místa činu, rekonstrukce významných znaků člověka, rekonstrukce významných předmětů a rekonstrukce významných jevů a událostí. Následně i definování a popsání znaků jednotlivých násilných trestných činů z pohledu kriminalistického. Cílem práce je také nastínění problematiky kriminalistické taktiky a probrání jednotlivých doporučených metod užívaných při vyšetřování jako jsou různé taktické postupy či taktické zásady. Dále také rozebrání jednotlivých možností a druhů konečné dokumentace tohoto způsobu dokazování.

Abstract:

My thesis is focused on the detailed analysis of a reconstruction of violent crimes. Crime reconstruction is one of the specific means of proofs and is regulated in the Criminal Procedure Code. We can find it at the fifth head, third part. With her there are other methods of proof, such as recognition, confrontation, examination and investigation. All these methods allow a detailed examination of the evidence in criminal proceedings for specific things, and the evidence to us. In my work I'm focusing on crime reconstruction, comparation legislation in other countries and on the similarities and differences with the experiment. I chose this topic because I think, that it should be more dismantled and addressed in circles of the Police of the Czech Republic. Especially to a modernising, or other means, to facilitate the work of the police. That's why I also mentioned in my work computer 3D method, which for us is not so widespread and accepted by court, but could be one of the main parts of forensic documentation. The main aim of my thesis is the analysis of the concept and the importance of reconstruction, the dismantling of its species, such as reconstruction of the place of the offense, reconstruction of major objects, the criminally significant acts and events and the external appearance of a human. Than the definition and describing types of violent crimes from the criminalistic point of view. The thesis is also discuss crime issues outline of recommended methods and tactics used in the investigation as there are various tactical procedures or tactical. And at the end the analysis of the various options and final documentation of the evidence.
