The princip of the ban of discrimination and its aplication in practice

Abstract:

Prvotní myšlenkou při výběru tematické oblasti diplomové práce v roce 2007, byl především požadavek zkoumat moderní právní úpravu s vyhlídkami pro uplatnění v budoucnu.Téma diplomové práce „Princip zákazu diskriminace a aplikace jeho aspektů v praxi“ bylo po pečlivém zhodnocení zvoleno na začátku druhé poloviny roku 2007, s očekáváním brzkého přijetí zcela nové, jednotné právní úpravy v této oblasti tj. antidiskriminačního zákona.Zamýšlená diplomová práce se měla zabývat především interpretací nové právní úpravy s důrazem na uvedení antidiskriminačních norem do aplikační praxe.Bohužel, k přijetí antidisriminačního zákona nedošlo (aktuální stav ke dni 30.3. 2009). Z důvodu neexistence antidiskriminačního zákona se v diplomové práci zaměřím ve značném rozsahu na rozbor pojmů především v teoretické rovině ve vztahu k mezinárodní a evropské právní úpravě. Nemohu opomenout rozbor vnitrostátní právní úpravy ve vztahu ke komunitárnímu právu a přihlédnu též k návrhu antidiskriminačního zákona. V otázkách uvedení zásady rovnosti a principu zákazu diskriminace do aplikační praxe jsem nucen vycházet především z judikatury Evropského soudního dvora, z důvodu faktické neexistence judikatury českých soudů v této oblasti. Předpokládám, že obsahem diplomové práce nebude pouhé vymezení zakázaného diskriminačního jednání, ale především důraz na nerovné jednání, které není diskriminací.

Abstract:

The author deals in his graduation theses with the present situation in harmonisation of the Czech law covering with the European Union law the principle of ban on discrimination and aplication of his aspects in the practices. Substiantial part of the graduation theses deals with the interpretation and especially application problems of securing of the principle of ban on discrimination and aplication of his aspects in the practices. In relation to the area of the european law conversant equality between men and women works the autor with following directives: Council Directive 75/117/EEC of 10 February 1975 on the approximation of the laws of the Member States relating to the application of the principle of equal pay for men and women; Council Directive 76/207/EEC of 9 February 1976 on the implementation of the principle of equal treatment for men and women as regards access to employment, vocational training and promotion, and working conditions; Council Directive 86/378/EEC of 24 July 1986 on the implementation of the principle of equal treatment for men and women in occupational pension schemes; Council Directive 92/85/EEC of 19 October 1992 on the introduction of measures to encourage improvements in the safety and health at work of pregnant workers and workers who have recently given birth or are breastfeeding; Council Directive 96/34/EC of 3 June 1996 on the framework agreement on parental leave concluded by UNICE, CEEP and the ETUC; Council Directive 96/97/EC of 20 December 1996 amending Directive 86/378/EEC of 24 June 1986 on the implementation of the principle of equal treatment for men and women in occupational social security schemes; Council Directive 97/80/EC of 15 December 1997 on the burden of proof in cases of discrimination based on sex; Council Directive 2000/78/EC of 27 November 2000 establishing a general framework for equal treatment in employment and occupation; Directive 2002/73/EC of the European Parliament and of the Council of 23 September 2002 amending Council Directive 76/207/EEC on the implementation of the principle of equal treatment for men and women as regards access to employment, vocational training and promotion, and working conditions. The author is also concerned within the international law with undermentioned treaties: International Pact on Civic and Political Rights (120/1976, Coll.); International Pact on Economic, Social and Cultural Rights (120/1976, Coll.); Convention on the Protection of Human Rights and Fundamental Freedoms (209/1992, Coll.); European Social Charter (14/2000 Coll.); No less important are conventions of the International Labour Organization: International Labour Organization Convention No. 111 of 1958 concerning Respect of Employment and Occupation (No. 465/1990, Coll.) International Labour Organization Convention No. 100 of 1951 concerning Equal for Men and Women Workers for Work of Equal Value (No. 450/1990, Coll.) Czech law and order is currently very disunited, inequable and incongruous. The acceptation of the Act of the principle of equal treatment for men and women as regards access to employment, vocational training and promotion, and working conditions is in the Czech law necessary.
