National security in the constitutional law of the Czech Republic

Abstract:

Moje bakalářská práce se především zabývá bezpečností státu a je rozdělena do sedmi hlavních kapitol. V obsahu první kapitoly vysvětluji pojem bezpečnosti státu a bezpečnostní systém jako takový. Následující kapitoly jsem věnovala vývoji právní úpravy z hlediska bezpečnosti státu nejen v rovině ústavní, ale i v rovině zákonné. V posledních dvou kapitolách stručně klasifikuji základní funkce a povinnosti státu a popisuji institucionální záruky bezpečnosti ČR. V poslední kapitole se zabývám současností a popisuji situaci, kdy a jakým způsobem k ohrožení státu došlo v minulosti, a jaké to přineslo změny v naší právní úpravě. Domnívám se, že otázkou bezpečnosti by se v současném světě měly zabývat vlády všech zemí, aby dokázaly ochránit nejen svá území, ale především své obyvatelstvo, a právě proto jsem si vybrala téma „Bezpečnost státu v ústavním právu ČR“. Jako cíl zpracování tohoto tématu jsem si stanovila analýzu dostupné starší a nové právní úpravy v České republice. V samotném závěru své práce zhodnotím, zda je činnost našeho státu ohledně bezpečnosti dostačující či nikoliv a zdůvodním proč.

Abstract:

My bachelor thesis deals primarily with national security and it is divided into seven main chapters. Within the content of the first chapter I explain the concept of national security and the security system itself. Following chapters are dedicated to evolution of legislation, not only in constitutional level, but also in statutory level. In the last two chapters I briefly classify basic functions and responsibilities of the state and I describe institutional guarantees of security of the Czech Republic. In the last chapter I deal with present and I describe the situation, when and how there was a threat to the state in the past, and what it has brought about changes in our legislation. I think that all governments are supposed to deal with the question of security in the contemporary world to protect not only the territories, but especially the populations. And it is the reason why I chose the topic "National security in the constitutional law of the Czech Republic". As a goal of elaboration of this topic I determined to analyze available old and new legislations in the Czech Republic. At the very end of the thesis I evaluate, whether the activities of our state regarding the security are sufficient or not and then I justify why.
