Mediation in non-criminal matters

Abstract:

V této bakalářské práci je tématem mediace, pouze v netrestní oblasti. V teoretické části jsou zpracovány kapitoly o konfliktu a komunikaci, což jsou hlavní pojmy s mediací související. V další kapitole definuji samotný význam mediace, její historii, formy, výhody a také legislativu mediace. Další kapitola je věnována účastníkům mediace a vztahům mezi nimi. Samotnou kapitolu tvoří role mediátora, fáze mediace a jednotlivé druhy dohod. Poslední kapitola je o jednotlivých netrestních oblastech, kde mohou spory vznikat. V praktické části této práce je kvalitativní výzkum, jehož cílem je zjištění efektivity a úspěšnosti práce mediátorů v netrestní oblasti.

Abstract:

In this thesis is the subject of mediation, only in non-criminal areas. The theoretical part presents chapters on conflict and communication, which are the main concepts related to mediation. In the next chapter I define the very meaning of mediation, its history, forms, benefits and legislation mediation. Another chapter is devoted to mediation participants and relationships between them. The actual role of the chapter consists of a mediator, mediation phase and different types of agreements. The last chapter is about the various non-criminal areas where disputes arise. In the practical part of this thesis is a qualitative research to determine the effectiveness and success of the work of mediators in non-criminal areas.
