Abstract:

Tato bakalářská práce se zabývá problematikou nutné obrany a krajní nouze, které jsou součástí okolností vylučujících protiprávnost. Práce má teoretickou a praktickou část. V praktické části uvádím kazuistiku jako výklad nutné obrany a krajní nouze ve vztahu ke konkrétnímu případu. Součástí práce je i provedení porovnání se zahraniční právní úpravou, zejména právní úpravou na Slovensku. V práci je využita judikatura, která poukazuje, jak funguje uplatnění nutné obrany a krajní nouze v praxi.

Abstract:

This bachelor thesis deals with the issue of the necessity and self-defence, which are two individual elements of the legal circumstances excluding the unlawfulness. The thesis has a theoretical and practical part. In the practical part, I present a case report as an interpretation of necessity and self-defence in relation to a specific case. Part of the thesis is also a comparison with foreign legislation, especially legislation in Slovakia. Additionally, the thesis comprises of case law, which shows the application of the necessity and self-defence in practice.
