Termination of employment based on unilateral legal action

Abstract:

Diplomová práce se věnuje tématu skončení pracovního poměru jednostrannými právními jednáními, konkrétně výpovědí, okamžitým zrušením pracovního poměru a zrušením pracovního poměru ve zkušební době, a to jak ze strany zaměstnavatele, tak ze strany zaměstnance. Kvalifikační práce popisuje jak obecnou charakteristiku pracovního poměru a jeho prvky, tak i samotné rozvázání pracovního poměru a jeho jednotlivé typy. Práce by měla přinést lepší orientaci v základních otázkách pracovního poměru a bližší zaměření na jednotlivé typy rozvázání pracovního poměru, protože toto téma je v současné době velmi aktuální. Další část práce má ukázat, jak se právní úprava pracovního poměru a jeho skončení aplikuje v praxi. Pro toto zjištění bude využit rozbor judikátů Nejvyššího soudu ČR a také dotazníkové šetření, které bude směřovat na konkrétní vybrané společnosti.

Abstract:

The diploma´s thesis deals with the topic termination of the employment through unilateral legal actions, namely resignation, immediate termination of the employment and termination of the employment during the probationary period, all on the part of the employer and on the part of employee. The qualification thesis describes the general characteristics of the employment relationship and its elements, as well as the termination of the employment relationship itself and its individual types. The work should bring a better orientation in the basic issues of the employment and a closer focus on individual types of termination of the employment relationship, because this topic is currently very actual. The next part of the work is intented to show how the legal regulation of the employment relationship and its termination is applied in practice. For this finding will be used an analysis of the case law of the Supreme Court of the Czech Republic, as well as a questionnaire survey, which will be aimed at specific selected companies.
