Cadastral proceeding - registration of rights to real estate, cadastre

Abstract:

My Bachelor´s thesis called Cadastral proceedings – registration of rights to real estate, the aim of the land register is to explain and clarify the establisment and development of the land registry in the contemporary Slovak Republic up to the present days and point mainly to cadastral proceedings specified by the law No. 162/1995, Collection of Laws, on land registry as a special category of administrative proceedings in which adjudication on rights, legally protected interests and duties of the participants in civil law relations takes place. In my thesis I decided to point to all categories of registration to the land registry from deposit to record and reference. The focus is on the deposit because it has the greatest consequence in law, as it causes the establisment, change or extinction of property right and jus in re to the property of another which means it has constitutive consequences. Extensive part of the thesis focuses on the land register because the present legal regulation of the land registry has been working, to some extent, on those principles administrated by the land register.

Abstract:

Bakalárska práca pod názvom Katastrálne konanie - zápis práv k nehnuteľnostiam, pozemková kniha má za cieľ vysvetliť a objasniť, vznik a vývoj katastra nehnuteľností na území dnešného Slovenska až po súčasnosť a predovšetkým poukázať na katastrálne konanie v zmysle zákona č. 162/1995 Z. z. o katastri nehnuteľností, ako osobitnom druhu správneho konania v ktorom sa rozhoduje o právach, právom chránených záujmoch a povinnostiach účastníkov konania. Vo svojej práci som sa rozhodla venovať všetkým druhom zápisov do katastra nehnuteľností a to vkladu, záznamu a poznámke, stým, že najväčšiu pozornosť venujem vkladu a to z dôvodu, že má naj ďaleko právne následky, pretože spôsobuje vznik, zmenu alebo zánik vlastníckeho práva a vecných práv k cudzej veci a teda má konštitutívne účinky. Rozsiahla časť je venovaná pozemkovej knihe a to z toho dôvodu, že súčasná právna úprava katastra nehnuteľností do istej miery vychádza zo zásad, ktorými sa riadila pozemková kniha.
