Legal Form of the State Supervision above the Insurance System

Abstract:

Anotace Pojišťovnictví, prestižní a dynamické odvětví finančního sektoru České republiky, sehrává a vždy sehrávalo velmi důležitou celospolečenskou roli. Na základě těchto celospolečenských potřeb a jejich naplňování sleduje stát svůj ochranný zájem formou dohledu nad pojistným trhem. Historie prvních právních norem dohledu státu nad pojišťovnictvím na našem území se formuje již od počátku 19. století, kdy byla naše země součástí Rakousko -Uherského soustátí. Od té doby prošlo pojišťovnictví řadou změn, do kterých stát svou významnou rolí vždy zasahoval. V naší novodobé polistopadové historii prochází pojišťovnictví obrovským dynamickým vývojem. Vedle neustálého posilování potřeb veřejnosti v hledání finančních jistot a ekonomické stability, kdy pojistitelé sami i prostřednictvím zprostředkovatelů svádějí denně na českém trhu nelítostný konkurenční boj o klienta, je z celospolečenského hlediska nutné vytvářet v podmínkách liberálního trhu vhodné právní prostředí dohledu státu nad pojišťovnictvím, které významně chrání spotřebitelské zájmy veřejnosti, odpovídá demokratickým principům České republiky a společným principům sjednocujícího se právního prostředí zemí evropské unie.

Abstract:

Annotation Insurance, a prestigious and dynamic branch of the financial sector of the Czech Republic, plays and always played a very important all-society role. On the basis of these all-society needs and their fulfilment, the State pursues its protective interest in the form of surveillance of the insurance market. History of the first legal rules of State surveillance of the insurance sector in our territory can be dated back to the beginning of the 19th century when our country was part of the Austro-Hungarian empire. Since then, the insurance sector has undergone a number of changes, the State always intervened to with its important role. In our modern post-November history, the insurance sector comes through the huge dynamic development. Along with continuous strengthening of the needs of the public in the search for financial security and economic stability, when the insurers themselves, and through intermediaries too, bring a cruel competition for the client on the Czech market on a daily basis, from the all-society view, it is necessary to create the appropriate legal environment of State surveillance of the insurance sector in the conditions of liberal market, which significantly protects consumer interests of the public, corresponds to democratic principles of the Czech Republic, as well as to the common principles of the unifying legal environment of the European Union countries.
