Social aspects of child custody after a divorce

Abstract:

Bakalářská práce popisuje problematiku sociálních aspektů svěření dítěte do péče rodičů po rozvodu. Definuje rodinu a popisuje její historický vývoj, vysvětluje příčiny a jednotlivé etapy rozvodu. Zaměřuje se na poměry po rozvodu zahrnující dětské obavy, reakce dětí na rozvod v jednotlivých vývojových etapách a pomoc dětem poskytovanou ze strany rodičů, prarodičů i orgánů sociálně právní ochrany dětí. Analyzuje jednotlivé druhy péče o dítě po rozvodu výlučná péče matky, výlučná péče otce, společná péče a střídavá péče; jejich výhody, nevýhody a současné "trendy". Poukazuje také na kritéria pro posuzování kvality výchovných předpokladů rodičů, roli nevlastních rodičů, nutnost kontaktu s druhým rodičem a rizika pro vývoj dítěte při nerespektování tohoto kontaktu. Cílem práce je utvořit ucelený přehled v porozvodové problematice se zaměřením na sociální aspekty dětí svěřených do péče po rozvodu. Informace v této práci jsou podloženy citacemi a komentáři nové právní úpravy vyplývající ze zákona č. 94/1963 Sb. o rodině. Problematice porozvodové péče se věnuje i praktická část této práce, kterou tvoří dvě formy výzkumu. První formu výzkumné části tvoří statistické údaje ministerstva spravedlnosti týkající se pravomocných rozhodnutí soudu v řízení o nezletilých dětech od roku 2002 do 2011. Druhou formu tvoří dotazníkové šetření, kterým byly zjišťovány sociální aspekty a důsledky rozvodu rodičů ve vztahu k dětem. Výsledky z výzkumné části byly porovnávány s fakty v části teoretické, které doplnily a současně potvrdily.

Abstract:

The bachelor paper describes the issue of social aspects of child custody after a divorce. It defines family and it describes its historical development. It explains the causes and separates phases of the divorce. It is pointing to conditions after the divorce, which includes child´s fear, child´s reactions and child´s help from parents, grandparents or social and legal protection agency. It analyses individual types of the child´s custody after the divorce exclusive mother´s custody, exclusive father´s custody, collective care and alternating care; it analyses advantages, disadvantages and current trends of each type. It also points to the criterions for assessment of the quality of parent´s presumptions, to a role of stepparents, to necessity of the contact with the second parent and also possible risks for child´s development without respecting the contact with both parents. The goal of this paper is to create complete summary of the problems, which children can have after divorce. The information which are included in this paper are based on quotations and recent comments of a new legal regulations based on the law n. 94/1963 Sb., a family law. In the practical part of the bachelor paper there are two parts of research. The first part consists of statistical data from Ministry of Justice in years 2002-2011. The second part consists of the questionnaire about the social aspects and consequences of the divorce for children. The results of both researches are compared with the information in the theoretical part of the paper, complete and at the same time also confirm it.
