Inaction and Action in Administrative Law

Abstract:

Diplomová práce se věnuje zásahu jako faktickému úkonu (jedné z forem činnosti veřejné správy) a také nečinnosti správních orgánů. Cílem práce je zejména vymezení pojmu „zásah“ ve světle právních předpisů, literatury a hlavně judikatury Nejvyššího správního soudu i Ústavního soudu, a jeho srovnání s nečinností. Práce poukazuje rovněž na skutečnost, proč je nečinnost v některých případech považována za druh zásahu. Důraz je v neposlední řadě kladen na ochranu před nezákonným zásahem i nečinností, a to jak v řízení před orgány veřejné správy, tak i ve správním soudnictví.

Abstract:

This thesis deals with an action as an effective act (one of the forms of activity of the public administration), and also with inaction of administrative authorities. The goal of this thesis is especially definition of the term „action“ according to legislation, relevant literature and mainly according to decision-making practice of The Supreme Administrative Court and also The Constitutional Court. The thesis also compares the term „action“ with the term „inaction“. The thesis also points to the fact why the inaction is sometimes considered the type of action. The emphasis is also on the protection against unlawful action and inaction, namely in the cases in front of the administrative bodies and in the administrative justice.
