The protection of international investments in international law during the armed conflict

Abstract:

The presented work focuses on the novel topic of the protection of foreign investments during armed conflict. This topic enjoys the attention of both academia and practice, especially in light of investment disputes between Ukrainian nationals and Russia or investment disputes against several states in Africa or the Middle East. This thesis tries to answer the question as to which norms of public international law govern the conduct of states in relation to foreign investments during armed conflict and what is the effect of the situation of armed conflict on the application of that legal framework. This research question consists of several elements. At first, it is necessary to address several preliminary remarks relating to the applicable fields of international law, to the issue of termination and suspension of treaties in times of armed conflict and to the concept of derogation from human rights instruments. Then, the thesis presents scenarios of situations where foreign investments suffer damage, with references to real cases. The thesis then identifies and applies to these scenarios relevant norms of international investment law, international humanitarian law and international human rights law. That allows the author to identify the most pertinent issues relating to the topic. The first major legal problem is the problematic applicability of bilateral investment treaties on the conduct of the occupying power in occupied territories. The thesis therefore engages in the interpretation of the term territory that predetermines the ratione loci scope of application of investment treaties. It also assesses the meaning of the duty of the occupier to respect the laws in force in an occupied territory and its potential effect on the applicability of investment treaties. The second major area of analysis, concerning the level of substance, relates to the qualification and solution of interactions and norms conflicts between norms applicable to defined scenarios, including the relationship between various exceptions (referring often to the concept of necessity). The thesis puts all these interactions and eventual conflicts of norms into a systematic order and analyses them in substance.

Abstract:

Předkládaná práce se zaměřuje na aktuální téma ochrany zahraničních investic v době ozbrojeného konfliktu. Dané téma je centrem zájmu doktríny i praxe, zejména na pozadí investičních sporů mezi ukrajinskými jednotlivci a společnostmi a Ruskem a investičních sporů vedených proti některým blízkovýchodním a africkým státům. Tato práce se pokouší odpovědět na otázku, jaké normy mezinárodního práva veřejného regulují chování států ve vztahu k zahraničním investicím v době ozbrojeného konfliktu a jaký je výsledný efekt ozbrojeného konfliktu na jejich aplikaci. Zodpovídání této otázky se skládá z několika elementů. Nejdříve je potřeba vypořádat několik teoretických východisek vztahujících se k určení aplikovatelných režimů mezinárodního práva, k otázkám přerušení nebo ukončení platnosti mezinárodních smluv v době ozbrojeného konfliktu nebo k institutu derogací v rámci lidskoprávních instrumentů. Následně mohou být představeny způsoby a scénáře, ve kterých dochází k poškození zahraničních investic, s uvedením reálných případů. Následně práce identifikovala a aplikovala pravidla z oblasti mezinárodního práva zahraničních investic, práva ozbrojených konfliktů a mezinárodních lidských práv. To umožňuje vymezit nejproblematičtější otázky související s daným tématem. První oblast se týká problematické aplikovatelnosti dvojstranných investičních dohod na chování okupující mocnosti na okupovaném území. Autor práce tedy komplexně interpretuje pojem "territory" který určuje teritoriální aplikaci těchto dohod. Dále je analyzován význam povinnosti okupující mocnosti respektovat účinné právo v okupovaném území ve vztahu k možné aplikaci investičních smluv na okupovaném území. Druhá rovina identifikovaných otázek se týká pojetí a řešení obsahových interakcí mezi aplikovatelnými pravidly v daných scénářích, a to včetně vzájemných vztahů a obsahu mezi rozličnými výjimkami z těchto norem (které často odkazují na pojem "necessity"). Tyto interakce a případně konflikty norem byly systematicky uspořádány a analyzován jejich obsah.
