Interests of Child during the education outside the Family - the Standards and Their Fulfilment in Comparative view

Abstract:

Práce obsahuje přehled standardů v oblasti ochrany rodiny a dítěte, které byly definovány mezinárodními organizacemi v závazných mezinárodních úmluvách, nezávazných rezolucích a doporučeních a ve výkladu kontrolních a rozhodovacích orgánů těchto organizací. Pozornost je kladena na postavení rodičů a dítěte v situacích, kdy je dítě z různých důvodů umístěno do péče mimo vlastní rodinu. Zhodnocena je možnost jednotlivce dovolat se zmíněných standardů u mezinárodních kontrolních orgánů. Přiblížena je i činnost mezinárodních neziskových organizací a jejich vliv na formulování standardů v této oblasti. Práce si klade za cíl porovnat obecně přijaté mezinárodní standardy a míru jejich aplikace v České republice. Za tím účelem popisuje systém ochrany rodiny a dítěte zakotvený v jejím právním řádu a přibližuje praxi kontrolních orgánů a soudů. Výsledkem je zjištění a popsání konkrétních nedostatků a návrh jejich řešení.

Abstract:

The thesis contains the overview of standards related to the protection of the child and the family that have been defined by international organizations in the form of binding international conventions, non-binding resolutions and recommendations as well as in the interpretation of the supervisory and decision-making bodies of such organizations. At the same time, the attention was focused on the position of the parents and the child in situations with the child being placed, based on different reasons, in the care outside his or her own family. The possibility of an individual of invoking the said standards before the international supervisory bodies has been assessed. In addition, the activities of the international non-profit organizations and impact of the non-profit organizations on the wording of the standards related to this field have been approached. The aim of the thesis was set to provide comparison of the generally accepted international standards and the extent of their application in the Czech Republic. To attain this goal, the thesis provides a description of the system of the protection of the child and of the family according to their being embodied in the legislation and approaches the practice of the supervisory bodies and courts. The result lies in the finding and description of concrete insufficiencies together with the proposal for their solution.
