Obstacles to Work on the Employee Side

Abstract:

Diplomová práce se zabývá institutem překážek v práci na straně zaměstnance. V jednotlivých kapitolách jsou nejprve vymezeny pojmy vztahující se k institutu překážek, historický vývoj překážek v práci a jejich prameny právní úpravy. Dále je zde analyzována platná právní úprava České republiky, Slovenské republiky, jejich legislativní rámec a způsoby jejich členění. Jednotlivé překážky jsou rozebrány v souvislosti s uplatněním jejich práva. Rovněž jsou zde definovány náhrady mezd poskytované zaměstnancům při vzniklých situacích od zaměstnavatele, ale také náhradní plnění poskytované na základě zákona o sociálním pojištění. Následující kapitola se zabývá vlivem překážek v práci na jiné pracovněprávní instituty. Práce je zakončena porovnáním těchto dvou platných právních úprav k nalezení vzájemných shod a rozdílů. V závěru diplomové práce jsou na základě současné právní úpravy předloženy některé návrhy de lege ferenda a doporučení.

Abstract:

The thesis deals with the institute of Obstacles to work on the employee side. In the individual chapters there are defined terms related to the institute of obstacles, historical development of obstacles at work and their sources of legal regulation. Furthermore, there is analyzed the current legislation of the Czech Republic, Slovak Republic, their legislative framework and ways of their classification. Individual obstacles are discussed in connection with the exercise of their rights. It also defines wage compensation provided to employees in the event of situations arising from the employer, but also compensation provided under the Social Insurance Act. The following chapter deals with the impact of obstacles to work on other labor law institutes. The work is concluded by comparing these two valid legal regulations to find mutual matches and differences. At the end of the thesis, on the basis of current legislation, some proposals de lege ferenda and recommendations are presented.
