Labour Migration: Case Study of Immigration of Highly Qualified Third Countries´ Ernst & Young Clients to the Czech Republic

Abstract:

Modrá karta je typem pracovního povolení Evropské unie určeným pro vysoce kvalifikované cizince ze třetích zemí. Její transpozice ze strany členských států stejně jako užití v praxi nicméně nedosahují takového úspěchu, jaký Evropská unie zamýšlela, a jsou velmi nerovnoměrné. Bakalářská práce se zabývá důvody, které vedou členské státy k nesprávné a pozdní transpozici směrnic, úrovní transpozice v případě směrnice o modré kartě, užitím modrých karet v české praxi a také v praxi Imigračního oddělení Ernst & Young. Teoretickým východiskem je legislativní proces a transpozice směrnic v kontextu migrační politiky Evropské unie ve vztahu k vysoce kvalifikovaným cizincům ze třetích zemí. Směrnice o modré kartě, jakožto jedna ze směrnic týkajících se ekonomické migrace, je předmětem zkoumání a práce si klade za cíl zodpovědět výzkumnou otázku ”Jak si Česká republika počíná v transpozici směrnic EU obecně a konkrétně v transpozici směrnice o modré kartě?”. Zkoumanými kritérii jsou dodržení lhůty stanovené pro transpozici směrnice a využití modrých karet v praxi na dvou úrovních; České republiky a Imigračního oddělení EY. Praktická část poskytuje náhled na klientská data Imigračního oddělení včetně postřehů dvou vysoce kvalifikovaných držitelů modré karty, se kterými byl veden rozhovor. Tyto informace taktéž dopomáhají k zodpovězení výzkumné otázky.

Abstract:

The Blue Card is a type of European Union work permit intended for highly qualified foreigners from third countries. Its transposition by the member states, as well as its use in practice, however, do not achieve the success that the European Union intended and are very uneven. The bachelor's thesis deals with the reasons that lead member states to incorrect and late transposition of directives, the level of transposition in the case of the Blue Card directive, the use of Blue Cards in the Czech practice and also in the practice of the Ernst & Young Immigration Department. The theoretical starting point is the legislative process and the transposition of directives in the context of the migration policy of the European Union in relation to highly qualified foreigners from third countries. The Blue Card Directive, as one of the directives related to economic migration, is the subject of research, and the thesis aims to answer the research question "How is the Czech Republic performing in the transposition of EU directives in general and specifically in the transposition of the Blue Card Directive?". The examined criteria are compliance with the deadline set for the transposition of the directive and the use of blue cards in practice on two different levels; in the Czech Republic and in the Immigration Department of Ernst & Young. The practical part provides an insight into the Immigration Department's client data, including responses and opinions of two highly qualified Blue Card holders who were interviewed.
