Abstract:

Práce se zabývá mimosmluvními instituty užití autorských děl, jakožto výjimky a omezení z autorských práv. V prvé části je nastíněn základ problematiky autorského práva obecně a právních pramenů z nichž vychází. Druhá část se zabývá předmětem autorského práva - autorským dílem a jeho druhy. Třetí část se již dotýká přímo mimosmluvních institutů, podává k tématu obecný výklad, nastiňuje základní dělení a obsahuje výklad k tříkrokovému testu, tedy zásadnímu nástroji při určování dovolené míry užití díla. Čtvrtá část se zaměřuje na jednotlivé mimosmluvní instituty a jejich zákonnou úpravu vycházející především z autorského zákona (121/2006 Sb.), ale také směrnic EU a mezinárodních smluv.

Abstract:

The topic of this thesis is non-contractual institutions of the use of copyrighted work. Though thepresent thesis is mainly part based on the Czech Act No. 121/2000 copyright act, it also contains description of international sources. The first part introduces to the topic from a general point of view. Second part desribes the object of copyright - the copyrighted work. In the third part, non-contractual institutions are seen from the general point of view. This part also explains the three-step-test which is used to find out if use of the copyrighted work is permitted or not. The fourth and last part describes specifically the non-contractual institutions and submits the interpretation about terms of its use.
