Limitation of Land Property Right Land by Reasen of Public Interest

Abstract:

Předmětem této práce je zpočátku nastínit historický vývoj a omezení vlastnického práva k pozemku a vymezit základní, bezprostředně související pojmy. Stěžejní náplní je rozbor současné právní úpravy, týkající se omezení vlastníka pozemku ve veřejném zájmu, a to nejprve v rovině ústavněprávní a dále pak z hlediska obecných a speciálních právních předpisů. Podstatná část je věnována institutu vyvlastnění, jako nejzávažnějšímu zásahu do vlastnictví konkrétního subjektu. Cílem práce je vedle systematického pojednání o jednotlivých omezeních, vyplývajících pro vlastníka pozemku ze značně roztříštěného a nepřehledného souboru právních předpisů, i upozornění na současné nejasnosti týkající se uvedené problematiky a nástin možného budoucího vývoje právní úpravy de lege ferenda.

Abstract:

The main purpose of this work is to present systematic and tabular comment of problems concerning to the limitation of the land ownership in public interest. The first part of the work is focused on the analysis of regulation of land owner's rights and its limitations based upon the public interest in the history. The second part deals with basic legal concepts and institutes which are directly connected with the land ownership and it's limitations in the public interest and the constitutional basis of the possibility of land ownership limitations. The fundamental part of the work is focused on specification of legal institutions of expropriation and easement. The relating part characterizes important statutes which enable limitation of the ownership when the most area is given to the statutes which are appointed to regulate the protection of nature environment. In the final part of the work are mentioned most important aspects of the legal regulation in the near future.
