Abstract:

TOLLINGEROVÁ, M. Dekrety prezidenta republiky v kontextu druhé světové války: bakalářská práce. Praha: Bankovní institut vysoká škola, a.s., Katedra práva a veřejné správy, obor Právní administrativa v podnikatelské sféře, 2012, 71 stran. Vedoucí práce: doc. JUDr. Bělovský, P. Bakalářská práce se zabývá vývojem a aplikací dekretů prezidenta republiky z let 1940 - 1945. V úvodu zkoumá právní a politické aspekty související se vznikem prozatímního státního zřízení a s působením londýnské exilové vlády. Probádává postavu prezidenta republiky dr. Edvarda Beneše. V další části zpracovává podmínky vzniku dekretů společně s jejich poválečnou ratihabicí a výkladem. To úzce souvisí i s poslední částí textu, která je věnována restitučnímu sporu hlubocké větve Schwarzenbergů a převodu majetku této šlechtické rodiny na zemi Českou podle zákona „lex Schwarzenberg“ z roku 1947.

This bachelor's thesis is dealing with development and application of the president's decrees from the years 1940 to 1945. The introduction is talking about the research of all legal and political sides connected to the formation of provisional government of Czechoslovakia. There is also explored the figure of president of the Republic, doc. Edvard Beneš. In the next part there are researched creation conditions of the decrees, their legal postwar approval and their explanation. This part is referring to the last part, which is dedicated to the restitution dispute of the Schwarzenberg family from Hluboká. Their property was transferred to the Czech country according to the act from 1947 called “lex Schwarzenberg”.
