Abnormally Low Tender Price - Current Tendency in the Decision-making Practice of the Office for the Protection of Competition

Abstract:

Předmětem diplomové práce Mimořádně nízká nabídková cena – aktuální tendence v rozhodovací praxi Úřadu pro ochranu hospodářské soutěže je vysvětlení tohoto neurčitého pojmu, upozornění na praktická úskalí a jejich vysvětlení za pomoci podrobné analýzy právní úpravy a zobecnění rozhodovací praxe Úřadu pro ochranu hospodářské soutěže a soudů. V první části se práce zabývá vysvětlením pojmu, důvodem jeho existence a ovlivněním základními zásadami, ve druhé části pak podobou současného zákona a především změnami oproti předchozím úpravám. Ve třetí části se nalézá vysvětlení praktických problémů institutu a ve čtvrté, závěrečné části jsou teoretické poznatky práce aplikovány na smyšlený praktický případ.

Abstract:

The subject of the submitted thesis Abnormally low tender price – Current Tendency in the Decision-making Practice of the Office for the Protection of Competition is an explanation of this undefined term, notification of practical issues and its explanation by detailed analyse of its legislation and generalization of the decision-making practice of the Office for the Protection of Competition and the courts. In the first part the thesis deals with an explanation of the term, with the reason of its existence and influence of the fundamental principles, in the second part with wording of the current bill and primarily with the changes when compared to the previous bills. In the third part can be found an explanation of the institute´s practical issues and in the fourth, final part, the theoretical findings are applied on a fictitious case.
