Abstract:

Tématem předložené bakalářské práce je problematika násilné trestné činnosti, která je páchána osobami s psychiatrickou zátěží, a to z pohledu Policie ČR. Jde o problematiku, která je veřejností a odborníky vnímána jako celospolečenský problém. Jde totiž o trestní odpovědnost těchto osob, neboť v drtivé většině, jde o osoby, které nejsou pro svou duševní poruchu či chorobu trestně odpovědné. Jelikož jde o osoby, které jsou v těchto případech nebezpečné společnosti a i sami sobě, a stávající zdravotnická zařízení nejsou ve vztahu zabezpečení na potřebné úrovni, musí stát zajistit svou dostatečnou ochranu. Právě proto přinesla novela zákona č. 40/2009 Sb., trestní zákoník, rozšíření podmínek ochranných opatření ve smyslu ustanovení § 98 odst. 1 trestního zákoníku o institut "zabezpečovací detence", podle § 100 trestního zákoníku, který do té doby neexistoval. Popis této problematiky, využívání institutů zabezpečovací detence a ochranného léčení, změn jednotlivých forem, a hlavně úskalí, které se v této oblasti vyskytují, jsou zcela jistě z odborného pohledu přínosné. Komparace dané problematiky s vybranými státy může naznačit směry, k ještě lepší ochraně společnosti. Důležitým momentem práce mohou být i případné návrhy de lege ferenda (podle budoucího zákona).

Abstract:

The topic of this bachelor thesis is the issue of violent crime, which is committed by persons with psychiatric burden, from the point of view of the Police of the Czech Republic. It is a problem that is perceived by the public and professionals as a societal problem. It is the criminal responsibility of these people, because they are overwhelmingly those who are not criminally responsible for their mental disorder or illness. As these are people who are in these cases dangerous to society and for themselves, and existing health establishments are not in a security relationship at the required level, the state must ensure that it is adequately protected. This is precisely why the amendment to the Criminal Code No. 40/2009 Coll. the extension of the conditions of protective measures within the meaning of Section 98/1 of the Criminal Code to the "security detention" institute, pursuant to § 100 of the Criminal Code, which had not existed until then. The description of this issue, the use of security detention institutions and protective treatment, the changes of the individual forms, and especially the pitfalls that occur in this area, are certainly of benefit from the expert point of view. Comparing the issue with selected states can indicate directions to further protect the company. An important part of the work can be any proposals de lege ferenda (according to the future law).
