Abstract:

"Nutná obrana a krajní nouze a jejich srovnání" V mé práci jsem se zabýval tématem Nutná obrana a krajní nouze a jejích srovnání. Moje práce se skládá z rzných ástí. V první ásti jsem se zabýval vykroením do problematiky okolností vyluujících protiprávnost, konkrétn nutné obrany a krajní nouze. Druhá ást obsahuje historický vývoj nutné obrany a krajní nouze na území eského státu od stedovku. Vývoj nauky o nutné obran na konci 18. století siln ovlivnila filosofie Emmanuela Kanta, kdy ústedním bodem jeho koncepce je pojem svobody. V této ásti jsem poukázal na rzné pojetí koncepce nutné obrany a krajní nouze od císaského patentu . 117/1852 .z., kterým byl vydán pro tehdejší rakouskou íši trestní zákoník, pes trestní zákon . 86/1950 Sb., až k trestnímu zákonu . 140/1960 Sb., který po provedení mnoha novelizací platí do souasné doby. Ve tetí ásti jsem popsal obecné vymezení nutné obrany, podmínky a meze nutné obrany, mezi které patí pímo hrozící a trvající útok, útok proti zájmu chránného trestním zákonem, pimenost a proporcionalita. Dále jsem se zabýval subjekty nutné obrany. tvrtá ást pojednává o krajní nouzi a to jejím obecném vymezení, podmínkami a mezemi krajní nouze, mezi které patí nebezpeí jako podmínka jednání v krajní nouzi, ohrožení zájm chránných trestním zákonem, subsidiarita jednání v krajní nouzi a proporcionalita jednání v krajní nouzi. Souasn jsem vymezil subjekty krajní nouze. V páté ásti jsem se zabýval srovnáním podmínek nutné obrany a krajní nouze s tím, že nejprve jsem popsal shodné podmínek nutné obrany a krajní nouze obecn a v závru této kapitoly jsem se blíže vyjádil ke shodným podmínkám spoleenské nebezpenosti a protiprávnosti. Dále jsem tedy popsal rozdíly mezi nutnou obranou a krajní nouzí a to v obecné rovin. V šesté ásti práce jsem opan popsal meze nutné obrany a krajní nouze a to konkrétn pekroení mezí nutné obrany a krajní nouze, kdy v první kapitole se zabývám excesem krajní nouze a ve druhé kapitole excesem nutné obrany. V závru své práce jsem konstatoval potebnost okolností vyluujících protiprávnost a jejich formáln normativní vymezení v trestním zákon. Dále jsem poukázal práv na co nejpesnjší normativní vymezení, sloužící k potebné právní jistot jednajících subjekt v nutné obran a krajní nouzi v pípadech, kdy jsou ohroženy i napadány zájmy chránné trestním zákonem. Také jsem zmínil chystanou novou právní úpravu trestního zákona a trestního ádu, kde ustanovení nutné obrany a krajní nouze zstane beze zmn. Do budoucna je zapotebí se stále zabývat okolnostmi vyluujícími protiprávnost a to i z dvodu, že se poet i brutalita spáchaných trestných in zvyšuje a orgány policie nemohou ochránit všechny zájmy spolenosti, skupin, jednotlivc, fyzických i právnických osob.

Abstract:

"The Legitimate defence and the Extreme dearth and their comparison". In my work I engaged in topic The Legitimate defence and the Extreme dearth and their comparison. My work consists of several parts, which I here described. In the first part I engaged in questions of the circumstances excluding the illegality the legitimate defence and the extreme dearth. The second part include the historic development of legitimate defence and extreme dearth in the Czech territory the Middle Ages to courrently. The development of the doctrine about legitimate defence influence philosophy of Emmanuel Kant from 18 century. His central point is concept of the freedom. In this part I wrote also about legitimate defence and extreme dearth from the Imperial patent number 117/1852. I engaged also in the Criminal Code, his historic development to courrently. In the third part I wrote about common determination of legitimate defence, than I wrote also about the conditions and the limits of legitimate defence. There ranks: - the directly threatening and continuing attack - the attack against the interest protected of the Criminal Code - the reasonableness and proporcionallity In this part I wrote about legal person of legitimate defence. The fourth part deals with extreme dearth. I wrote about common definition, conditions and limits of extreme dearth. This conditions and limits are these: - the danger like condition of procedeeing of extreme dearth - the endangering interests protected by the Criminal Code - the subsidiarity act in extreme dearth I defined legal person of extreme dearth. In the fifth part I wrote about the comparison of legitimate defence and extreme dearth. The first I described their identical conditions. I wrote only in common flatland. Than I described identical conditions of social dangerousness and ilegallity. In the sixth part I described their limits I engaged with transgression limits of these and with exces of legitimate defence the first and than I wrote about exces of extreme dearth. In conclusion I described the circumstances excluding the illegality the necessity speak about this big problem, their normative determination in the Criminal Code. It must serves to necessary legal certainty person, which it in legitimate defence or extreme dearth acts.It is important in this cases mainly, where the interests protected herein endangered are. I wrote also about the Criminal Code and the Rules of Criminal procedure, about a new legal regulation, because the brutality and number of criminal acts is increasing now.
