Abstract:

Diplomová práce se zabývá sporem o soulad prezidentem Reaganem vyhlášené Strategické obranné iniciativy se Smlouvou mezi Svazem sovětských socialistických republik a Spojenými státy o omezení protiraketových systémů z roku 1972 (dále jen „smlouva o protiraketové obraně“). V roce 1985 představila Reaganova administrativa tzv. širokou interpretaci smlouvy o protiraketové obraně, dle které smlouva nezakazovala výzkum, testování ani vývoj protiraketových systémů či komponent využívajících exotických technologií a to bez ohledu na jejich umístění. Reaganova reinterpretace se nicméně dočkala silného odporu z Kongresu i ze zahraničí. V první části diplomová práce rozebírá obecný koncept právního výkladu i pravidla interpretace jak je kodifikuje Vídeňská úmluva o smluvním právu. Po krátkém představení obsahu ustanovení smlouvy o protiraketových systéme se práce dále věnuje argumentům obou stran výkladového sporu, tj. tzv. tradicionalistů a zastánců reinterpretace, jak ji představila Reaganova administrativa. Cílem diplomové práce je verifikovat následující tvrzení: „Ačkoliv byla Reaganovou administrativou navržená reinterpretace smlouvy o protiraketových systémech politicky nutná a strategicky žádoucí, nedostalo se jí dostatečné opory v právu.“

Abstract:

The thesis deals with the dispute over the compliance of the President Reagan’s Strategic Defense Initiative with the Treaty between the United States and the Union of Soviet Socialist Republics on the Limitation of Anti-Ballistic Missile Systems (further referred to as “ABM Treaty”). In 1985 the Reagan administration introduced the so called broad interpretation of the ABM Treaty under which research, development and testing of all exotic ABM systems or components would have been permitted (regardless their basing mode). Strong opposition followed from both the U.S. Congress and abroad. In the first part the thesis elaborates briefly on the general concept of legal interpretation and rules of interpretation as codified in the Vienna Convention on the Law of Treaties. After short introduction of the ABM Treaty provisions the thesis presents arguments of both sides of the interpretation dispute, namely of the so called traditionalists and the proponents of the Reagan administration’s reinterpretation. The aim of the thesis is to verify the following statement: to verify the following statement: “While being politically necessary and strategically desirable, the so called broad interpretation of the ABM Treaty as proposed by the Reagan administration did not have a sufficient foundation in law.”
