Bill of Exchange Theories from the Perspective of Current Legal Regulation

Abstract:

Diplomová práce uceleně popisuje tzv. směnečné teorie zabývající se podstatou vzniku směnečného závazkového vztahu a s tím spojenou otázkou způsobu nabytí směnečných práv při převodu směnečné pohledávky indosamentem. Spolu se shrnutím literatury a judikatury vztahující se ke vzniku směnečného závazkového vztahu a převodu směnečných práv rozvádí možnou použitelnost jednotlivých směnečných teorií na české právní prostředí. Práce dále uvádí argumenty pro přijetí smluvní směnečné teorie a použitelnost tzv. teorie domnělých práv.

Abstract:

This diploma thesis describes the bill of exchange theories, dealing with the essence of the rise of the bill of exchange liability and with the question of acquiring rights by endorsement transfer of bill of exchange receivable. Along with a summary of the literature and case law related to the the rise of the bill of exchange liability and the transfer of the bill’s rights thesis deals with expansion of the possible applicability of various bills of exchange theories on the Czech legal system. This work shows the arguments for adopting the bill contract theory and the applicability of the theory of presumed rights.
