Abstract:

Diplomová práce se věnuje oblasti vydávání a regulace elektronických peněz v České republice, jejich právní úpravě a aktuálním změnám, které nastaly v souvislosti s novým zákonem o platebním styku č. 370/2017 Sb. Práce vychází z aktuálních právních předpisů: zákonů, vyhlášek a mezinárodních právních předpisů z oblasti platebního styku, zejména Směrnice Evropského parlamentu a Rady 2009/110/ES ze dne 16. září 2009 o přístupu k činnosti institucí elektronických peněz, o jejím výkonu a o obezřetnosti a dohledu nad touto činností. Hlavním cílem práce je prozkoumat a vymezit hlavní tendence vývoje oběhu elektronických peněz v České republice v letech 2011-2016 a nastínit předpoklady pro jejich budoucí vývoj. V teoretické části byl proveden rozbor právních předpisů věnujících se regulaci elektronických peněz a jejich oběhu v České republice a v Evropě. Dále v práci byla provedena analýza statistických údajů o oběhu elektronických peněz v České republice a jiných vybraných zemích EU, statistika vydavatelů elektronických peněz ve vybraných evropských státech a jejich činnosti. V praktické časti práce je proveden rozhovor s vlastníkem společnosti, která je zapsána v registru vydavatelů elektronických peněz malého rozsahu vedeném Českou národní bankou.

Abstract:

The diploma thesis deals with the field of electronic money in the Czech Republic, their legal regulations and changes, which occurred in connection with the new Act on Payment System No. 370/2017 Coll. The work is based on current legislation: laws, regulations and international directives in the field of payment systems, in particular Directive 2009/110/EC of the European Parliament and of the Council of 16 September 2009 on the taking up, pursuit and prudential supervision of the business of electronic money institutions. The main aim of the thesis is to investigate and define the main trends in the development of electronic money circulation in the Czech Republic in 2011-2016 and to outline the prerequisites for their future development. In the theoretical work was analyzed the legal regulations dealing with electronic money and their circulation in the Czech Republic and Europe. Furthermore, statistical analysis on the circulation of electronic money in the Czech Republic and other selected EU countries, statistical analysis of issuers of electronic money in selected European countries and their activities were carried out. In the practical part of the thesis an interview is held with the owner of the company, which is registered in the register of small-scale electronic money issuers led by the Czech National Bank.
