Control over Management of Czech Public Finance

Abstract:

Autor se své diplomové práci věnuje kontrole hospodaření s veřejnými financemi, v rozsahu zákona č. 320/2001 Sb., o finanční kontrole, a efektivitě těchto kontrol. Cílem práce bylo zjistit, zda samotná právní úprava je plně souladná s účelem a smyslem dané právní úpravy či nikoliv. Důraz byl kladen na koncepci finanční kontroly ve světle zákona č. 320/2001 Sb., o finanční kontrole, a jeho prováděcích předpisů a rovněž byl zohledněn jeho předpokládaný vývoj. Zároveň byla provedena komparace s právní úpravou v Belgickém království. Po analýze a komparaci lze shrnout, že právní úprava obsahuje několik problematických úseků v oblasti postupů v řídící kontrole, v úpravě interního auditu a taktéž i v metodologickém vedení kontrolních orgánů, což ve své provázanosti zapříčiňuje ztížení efektivity provádění kontrol.

Abstract:

In this diploma thesis author discusses control over management of public finance and its effectivity, however only in the scope of Act no.320/2001 Coll., on financial control, as amended. The aim of this thesis was to determine whether the legislation itself is fully in conformity with the purpose and meaning of the legislation or not. Emphasis was placed on the concept of financial control in light of the Act no.320/2001 Coll., on financial control, and its implementing regulations and also its expected development was taken into account. Moreover, comparison was made with the legislation in Belgium Kingdom. After analysis and comparison, it can be summarized that the legislation contains several problematic sections in management control, in the regulation of internal audit and also in the methodological guidance of control authorities, which in its interconnection causes hindering the effectiveness of execution of controls.
