Tax Control

Abstract:

Diplomová práce na téma „Daňová kontrola“ pojednává o základních institutech daňové kontroly, porovnání s místním šetřením a především o právech a povinnostech daňového subjektu. Jsou též vymezeny rozdíly mezi kontrolou, dohledem a dozorem.V práci je v jednotlivých kapitolách pojednáno o daňové kontrole, od zásad, přes přípravu, průběh až po ukončení a její možné finanční a trestněprávní následky. Doplněna je relevantní judikatura, která ve značné míře ovlivňuje postavení daňových subjektů a postřehy z praxe. Pozornost je též věnována změnám, které přinese daňový řád platný od roku 2011.

Abstract:

The diploma thesis on „Tax control“ is focused on basic institutes of tax control, its comparison with local inquiry and , above all, rights and duties of the tax subjects. The thesis also defines the difference between control and supervision. The thesis includes the description of process of the tax control: canons of taxation - the principles which have to be followed during the whole tax procedure; tax control from its preparing, through the process of control to its finalization and potential financial and criminal consequences. The tax control is complemented by judicature which largely influences the position of tax subjects and tax administrators; also includes observation of practice. The description of new legislation is also included.
