Abstract:

Tato diplomová práce se zabývá trestnou činností mládeže, tedy dětí mladších patnácti let a mladistvých, která je závažným sociálně-patologickým jevem. Práce je zaměřena na co možná nejvíce souvisejících témat s touto problematikou, jako specifické znaky trestné činnosti mládeže, trestní odpovědností mládeže, která v sobě zahrnuje často medializovaný problém věkové hranice trestní odpovědnosti nebo prevence. Větší důraz je přesto kladen na cílenou soustavnou práci s dětmi a mladistvými a na prevenci v kontextu se zvážením faktorů, které dnešní mládež vedou k páchání trestné činnosti a následně užité sankce. Opomenout se nesmí ani pomoc těm, kteří se trestné činnosti již dopustili a pokusit se jim pomoci najít co možná nejlepší cestu k začlenění se zpátky do společnosti a dále pokračovat v jejich životě jako slušní lidé. V práci se také objevují podnětné rady z praxe státního zastupitelství. Náš systém je dle mého názoru vcelku dobře nastaven, přesto je nezbytné zapracovat na větší provázanosti a spolupráci jednotlivých institucí, které se touto problematikou zabývají.

Abstract:

This thesis deals with the criminal activities of children and juveniles, which is serious socio-pathological phenomenon. Thesis is focused on as much as possible topics related to this issue, as the specific characteristics of youth crimes, criminal liability of the youth, which includes often publicized problem of age limit of criminal liability and prevention. Considerable focus is still placed on targeted systematic work with children and juveniles and prevention in the context of considering the factors that lead today´s youth to commit crime and then used a penalty. It shouldn´t be overlooked either help those who have committed a crime and try to help them find the best possible way to integrate them back into society and resume their lives as decent people. In this thesis also appear interesting practice advice from public prosecution. Our system is, in my opinion quite well set up, but it´s necessary to incorporate a greater coherence and cooperation between institutions that deal with this problem.
