Sense of the passage of time in civil law

Abstract:

The primary aim of the thesis was to analyze the importance of the passage of time as an objective legal reality that impacts on some selected institutes of civil law . The first chapter of this work has focused on the issue of age and defining the lower limit of age for legal action . In the first subsection , we discussed the definition of age in relation to substantive law . The second sub-chapter was devoted to procedural rights, and in it we have also addressed the age necessary for the realization of this right . The second chapter of the work was focused on the characterization of two important concepts in the civil law . The first one was time-barred . In it we have defined what a statute of limitations and define the various facts related thereto . The second concept that we have devoted space was prescription . Even there , we were focused on the specifics . We also identified differences between these two concepts . Tackling the time-limits we addressed in the next subsection of this chapter . In it , we discussed the commencement and the end point of those periods . The last sub-section area of the passage dealing with these deadlines . Last chapter of our work area address enduring . In the first subsection , we discussed what it represents enduring , as understood by the individual authors . We also draw on the judgments relating to enduring . His attention was also focused on the situation when there is a delay of the debtor or the creditor and what consequences flow from this fact .

Abstract:

Primárnym cieľom záverečnej práce bolo analyzovať význam plynutia času ako objektívnej právnej skutočnosti vplývajúcej na niektoré vybrané inštitúty občianskeho práva. Prvá kapitola tejto práce sa orientovala na problematiku veku a vymedzenie dolnej hranici veku potrebného na právne úkony. V jej prvej podkapitole sme sa zaoberali vymedzením veku v súvislosti s hmotným právom. Druhá podkapitola bola venovaná procesnému právu a taktiež sme v nej riešili vek nevyhnutný pre realizáciu tohto práva. Druhá kapitola práce bola zameraná na charakteristiku dvoch významných pojmov v občianskom práve. Tým prvým bolo premlčanie. Pri ňom sme si definovali čo je to premlčanie a vymedzili rôzne skutočnosti, ktoré s nim súvisia. Druhým pojmom, ktorému sme venovali priestor bola preklúzia. Aj v nej sme sa orientovali na jej špecifiká. Zároveň sme určili rozdiely medzi týmito dvoma pojmami. Riešeniu problematiky plynutia lehôt sme sa venovali v nasledujúcej podkapitole tejto kapitoly. V nej sme sa zaoberali začatím a koncom plynutia lehôt. Posledná podkapitola sa zaoberala oblasťou plynutia týchto lehôt. Záverečná tretia kapitola našej práce riešila oblasť vydržania. V jej prvej podkapitole sme rozoberali čo to vlastne vydržanie predstavuje, ako ho chápu jednotlivý autori. Upriamili sme sa tiež na súdne rozhodnutia týkajúce sa vydržania. Svoju pozornosť sme taktiež sústredili aj na situáciu, kedy dôjde k omeškaniu dlžníka alebo aj veriteľa a aké dôsledky z tejto skutočnosti plynú.
