Asylum as a Form of International Protection

Abstract:

In the presented thesis, the author is dealing with international protection in the form of asylum, with an emphasis on the substantive side of the regulation. For the completion of the topic, at first the basic concepts relating to the field are defined on the international, European and national level. Subsequently, she introduces the legislation, which is closely related to the topic, with the most important contribution of each source on the current form of the regulation. She also deals with various forms of international protection in the Czech Republic. The main focus of the work is on the analyses of the grounds for granting and withdrawing asylum, which is mainly based on working with the sources of the legislation and case law of the Supreme Administrative Court.

Abstract:

V predkladanej diplomovej práci sa autorka venuje medzinárodnej ochrane vo forme azylu, s dôrazom na hmotneprávnu stránku veci. Pre ucelenie problematiky najprv vymedzuje základné pojmy týkajúce sa danej oblasti, a to na medzinárodnej, európskej a národnej úrovni. Následne uvádza pramene právnej úpravy, ktoré úzko súvisia s danou problematikou, s uvedením najvýznamnejšieho prínosu jednotlivých prameňov. Taktiež sa zaoberá jednotlivými formami medzinárodnej ochrany v Českej republike. Hlavným ťažiskom práce sú analýzy dôvodov udelenia a odňatia azylu, pri ktorých sa zamerala na prácu s formálnymi prameňmi právnej úpravy a s judikatúrou Najvyššieho správneho súdu.
