The Jurisdiction of the International Criminal Court

Abstract:

Cílem práce je odpovědět na otázku, jak jsou podmínky jurisdikce Mezinárodního trestního soudu uplatňovány v praxi, v rámci činnosti tohoto soudu. Základní kritéria pro určení, zdali věc spadá do jurisdikce soudu, jsou obsažena již v zakládajícím dokumentu, kterým je Římský statut. Cílem práce je na základě analýzy činnosti Mezinárodního trestního soudu dojít k závěrům, jak jsou tato kritéria v konkrétních situacích, jež jsou předmětem řízení před soudem, vykládána a následně i aplikována. Soud tímto dotváří právo, které je obsaženo ve Statutu. Určuje metody výkladu a způsob aplikace ustanovení týkajících se jurisdikce soudu. Práce se skládá ze dvou hlavních částí, teoretické a empiricko-analytické. První část se zabývá jednotlivými typy jurisdikce Mezinárodního trestního soudu (věcnou, časovou, územní, osobní a komplementární) a předpoklady pro její výkon. Teoretická část práce vychází zejména z textu Statutu a odborných publikací a článků znalců mezinárodního práva, kteří se výkladem jeho ustanovení týkající se jurisdikce ve svých pracích věnovali. Druhá část práce se týká samotné činnosti Mezinárodního trestního soudu. Tato, empiricko-analytická část práce je rozdělena do šesti kapitol, které se věnují situacím, v rámci nichž žalobce (popř. přípravný senát) rozhodl, že věc spadá do jurisdikce soudu. Analyzovány jsou situace týkající se Ugandy, Demokratické republiky Kongo, Středoafrické republiky, Súdánu, Keni a Libye. Účelem této části práce je provést komparativní analýzu jednotlivých situací na základě toho, jak u nich byla splněna kritéria pro uplatnění jurisdikce Mezinárodního trestního soudu.

Abstract:

Deciding whether to initiate an investigation, the Prosecutor of the ICC or the Pre-Trial Chamber shall consider, among other things, whether the available information provides a reasonable basis to believe that a crime within the jurisdiction of the Court has been or is being committed. The jurisdiction of the ICC has four different facets: subject-matter jurisdiction (ratione materiae), jurisdiction over persons (ratione personae), territorial jurisdiction (ratione loci) and temporal jurisdiction (ratione temporis). The fifth type of jursidiction is based on the principle of complementarity whereby the Court is subsidiary to national courts. Primary responsibility to investigate and punish international crimes is therefore left to individual states.The jurisdictional parameters must be taken into account in every situations in which the Prosecutor or the Pre-Trial Chamber is determining that they can open an investigation. The court has still opened investigations into six situations: Uganda (Northern Uganda), the Democratic Republic of the Congo, the Central African Republic, Sudan (Darfur), the Republic of Kenya and Libya. Three of them were referred to the Court by the states parties (Uganda, the Democratic Republic of the Congo and the Central African Republic), two were referred to the United Nations Security Council (Sudan and Libya), one investigation was initiated by the Prosecutor proprio motu. This thesis consists of two main parts (theoretical and empirical-analytical). Theoretical part is devoted to the jurisdictional criteria according to the Rome Statute. It analyses different facets of ICC´s jurisdiction, preconditions to the exercise of jurisdiction and how the ICC may exercise its jurisdiction. This part is predominantly conducted with the descriptive method and grammatical and teleological method of interpretation. The second part focused on the individual situations (Uganda, the Democratic Republic of the Congo, the Central African Republic, Sudan, the Republic of Kenya and Libya). This part is predominantly conducted with the empirical-analytical method. The main question of this thesis is how the jurisdictional criteria have been applied to individual situations.This study provides a comparative analysis of six situations that have been recognized satisfactoryto the jurisdictional parameters of the ICC.
