International law protection of human rights: limitations in case of public health protection

Abstract:

Tato bakalářská práce se zaměřuje na posouzení opatřeních, které vedli k omezení lidských práv kvůli ochraně veřejného zdraví, a to právě v souvislosti s pandemií covid-19, všechna omezení byla v souladu s mezinárodněprávními normami. V práci jsou analyzovány relevantní mezinárodní právní předpisy, jako je Mezinárodní pakt o občanských a politických právech a Mezinárodní pakt o hospodářských, sociálních a kulturních právech, a jejich vztah k omezení lidských práv v případě ochrany veřejného zdraví. V rámci práce jsou zkoumány dopady pandemie covid-19 na dané státy a následné porovnání s opatřeními přijatými státy. Analýza zahrnuje země s různými přístupy k řešení pandemie, země, jež se budou komparovat jsou Česko, Čína, Spojené státy americké (Kalifornie) a Uganda. Výsledek práce se zaměřuje, jak daná opatření, reakce státu a další faktory ovlivnily vývoj pandemie v jednotlivých zemích. Práce ukazuje, že úmrtnost v důsledku pandemie covid-19 je ovlivněna mnoha faktory, včetně věkové struktury obyvatelstva, dostupnosti zdravotnického zařízení a účinnosti opatření přijatých státy. Závěry práce pomohou lépe porozumět souvislostem mezi omezením lidských práv a ochranou veřejného zdraví v době pandemie covid-19 a přispějí k lepšímu informovanému rozhodování při případných budoucích krizových situacích.

Abstract:

This bachelor thesis focuses on assessing measures that led to the restriction of human rights for the protection of public health, specifically in the context of the COVID-19 pandemic. These all restrictions were in accordance with international legal norms. The thesis analyzes relevant international legal provisions such as the International Covenant on Civil and Political Rights and International Covenant on Economic, Social and Cultural Rights, and their relationship to the restriction of human rights in the case of public health protection. The next part of this thesis is to examine the impact of the COVID-19 pandemic on specific countries and compares their respective measures. The analysis is done on specific countries: the Czech Republic, China, the United States of America (California), and Uganda. These countries had different approaches to addressing the pandemic. The thesis results focus on how these measures, state responses, and other factors influenced each country's pandemic development. The thesis demonstrates that COVID-19 mortality is influenced by many factors, including population age structure, access to healthcare facilities, and the effectiveness of measures adopted by the states. The thesis's conclusions will help to better understand the links between the restriction of human rights and the protection of public health during the COVID-19 pandemic and will contribute to more informed decision-making during future crises.
