Constitutional principles of electoral law in light of judicatory of the Constitutional Court in Czech Republic

Abstract:

Diplomová práce shrnuje základní ústavní a zákonná vymezení volebního práva v České republice. Analyzuje závěry judikatury Ústavního soudu týkající se této problematiky v jejich vývoji a změnách. Cílem práce je vyzdvihnout případy konkrétní kontroly ústavnosti Ústavním soudem. Problémy abstraktní kontroly ústavnosti jsou zmíněny pouze okrajově pro ucelenější pohled na zkoumané téma. Po teoreticko-historickém úvodu vymezuji volební právo obecně (dle Ústavy ČR, Listiny základních práv a svobod a příslušných zákonů) a uvádím čtenáře do problematiky volebních systémů pro orgány územní samosprávy, Parlament ČR a Evropský parlament. Výklad plynule přechází k otázce soudní ochrany voleb, která je nezbytným atributem svobodných a demokratických voleb ve vlastní slova smyslu. Přes vymezení různých pojetí soudního přezkumu voleb se autorka dostává k jádru práce, k judikatuře Ústavního soudu a její závaznosti. Závěr práce tvoří příklad diskuze nad nálezem Ústavního soudu a polemiky týkající se budoucího vývoje právní úpravy soudního přezkumu voleb v ČR.

Abstract:

The thesis summarises general constitutional and legal determination of electoral law in the Czech republic. It analyses the conclusions of Constitutional courts judicatory involving their progress and modification. A purpose of the thesis is to point out a particular verification of constitutionality by the Constitutional Court. Problem of abstractive control of constitutionality is mentioned just marginally for only comprehensive view on a whole situation. After the theoretical and historical prologue the author determines a suffrage generally and introduces the readers to broad issues of electoral system of the bodies of municipal authorities, members of Czech Parliament and European Parliament. Interpretation fluently comes to the point of courts protection of the elections, which is a necessary attribute for free and democratic elections. Through determination of various concepts of courts electoral reviews the author is getting to the heart of thesis, the practices of the Constitutional court and its obligation. The end of the thesis gives the examples of discussion on Constitutional courts finding and brings the arguments pertaining future progress in modifications of regulations of courts electoral review in Czech republic.
