The authorized use of a weapon as a circumstance excluding illegality in history and present times

Abstract:

Práce se zabývá problematikou § 32 trestního zákoníku. Jednak obsahuje aktuální problematiku, ale zároveň dokládá i vhled do historie veřejných sborů, jejichž legislativa fungovala obdobně. Diplomová práce v části věnované současné právní úpravě přináší srovnání oprávnění k použití zbraně mezi jednotlivými veřejnými sbory, jejichž rozdíly v oprávněních vycházejí z odlišné právní úpravy. V závěru práce je proveden kvalitativní výzkum názorů příslušníků některých útvarů na současnou právní úpravu a také na jejich praktické zkušenosti s ustanovením § 32 trestního zákoníku.

Abstract:

The thesis deals with the theme of Section 32 of the Criminal Code. On the one hand, it addresses contemporary problems, but it also provides an insight into the history of law enforcement agencies that have operated in a similar manner. In the part dealing with current legislation, the dissertation compares the right to use weapons between individual law enforcement units, whose different powers are based on different legislation. At the end of the thesis there is a qualitative research on the opinion of officers of some forces about the current legislation and also about their practical experience with the provisions of Section 32 of the Criminal Code.
