Abstract:

Násilí páchané na ženách a dětech jsou v posledních letech stále více diskutovaným problémem , který znamená zásadní porušování lidských práv . Bakalářská práce „Trestné činy páchané na ženách a dětech, se zaměřením zejména na §§215 a 215a Trestního zákona“ pojednává o české trestněprávní úpravě a kriminologických aspektech společensky nežádoucího jevu tzv.domácího násilí. Tento negativní fenomén, vyskytující se v rodinách a domácnostech, byl dlouhou dobu státními institucemi vnímán jako okrajová a ryze soukromá záležitost.Dnem 1.6.2004 nabyla účinnosti novela Trestního zákona č. 91/2004 Sb., kterou lze vnímat jako první krok na cestě k řešení a pomoci obětem domácího násilí. Vedle platného ustanovení tr. zákona § 215 - Týraní svěřené osoby byla touto novelou nově zavedena skutková podstata trest.činu § 215a - Týrání osoby žijící ve společně obývaném bytě nebo domě , jež se běžně interpretuje právě jako ochrana před projevy domácího násilí. První část práce je věnována pojmovému vymezení domácího násilí, znakům, formám, příčinám a mýtům, s diferenciací násilí páchaného na ženách, a násilí v rodinách páchaného vůči dětem. Z kriminologického pohledu se zaměřuji na příčiny a latenci domácího násilí, charakteristiku pachatele a oběti, viktimizaci, prevenci a intervenci domácího násilí. Z hlediska právních úprav věnuji hlavní pozornost stávající trestněprávní úpravě, zhodnocení přínosu uvedené novely, a zejména výkladu §§ 215 a 215a , ale i dalších skutkových podstat trestního zákona a procesních aspektů postihujících danou oblast násilí, a to s ohledem na možnou úpravu de lege ferenda.

Abstract:

Problem with violence committed on women and children has been in past years more and more discussed and means essential violation of human rights. This bachelor work called “Crimes against women and children, primarily in accordance with §§ 215 and 215a of the Criminal Code“ deals with Czech criminal regulation and criminological aspects of undesirable phenomenon also called as domestic violence. This negative phenomenon which occurs in families and households has been for long time understood by state authorities as a private and side issue. Amendment of the Penal Code no 91/2004 Coll. came into force 1st June 2004 and can be perceived as a first step of solution and aid to the victims of domestic violence. Besides valid regulation laid down by the Penal Code in Section 215 – criminal offence of tormenting in wardship this amendment regulates new special factum as codified in Section 215a – criminal offence of tormenting a person living in the same house or apartment which has been so far interpreted as protection against manifestation of domestic violence. First part of this work is attended to define domestic violence and its features, forms, causes and myths with differentiation to violence committed on women from family violence committed on children. From the criminological point of view I want to focus on causes and latency of domestic violence, characteristics of the offender and the victim, victimization, prevention and intervention of domestic violence. From the point of legal regulation I want to attend main attention to existing criminal regulation and summing up contribution of above mentioned amendment, particularly interpretation of Section 215 and Section 215a, and also interpretation of other facts of the Penal Code and procedural aspects affecting field of violence with respect to regulation de lege ferenda.
