Protection of Personality

Abstract:

Bakalářská práce pojednává o ochraně osobnosti fyzické osoby. Jsou zde řešeny otázky obecné povahy, jedná se o historický vývoj s uvedením pramenů, vysvětlení pojmu a charakteristiky všeobecného osobnostního práva. Také jsou zmíněny subjekty všeobecného osobnostního práva, možnosti omezení a právní prostředky tohoto práva, kterými se dotčená fyzická osoba může bránit u soudu. Je zde učiněna i úvaha de lege ferenda. Dále jsou v práci rozebrány jednotlivé dílčí osobnostní práva fyzické osoby s uvedením ilustračních příkladů a zároveň jsou zmíněny různé oblasti právního řádu, kde může dojít k porušení práv fyzické osoby. V závěru práce je vylíčeno, v jakém vztahu je svoboda projevu a kritika politicky činných osob. V této části práce dochází k vymezení pojmu svobody projevu, mezí přípustné kritiky a také jsou tu uvedeny judikatury evropských a amerických soudů.

Abstract:

Bachelor's thesis deals with the protection of natural persons personality. There are questions addressed general nature, it is a historical development with the sources, the notion of the general characteristics and personality rights. Also discussed are general entities personality rights, opportunities and legal restrictions on this right means that the natural person may hinder them in court. There is also consideration made de lege ferenda. There are also addressed in the work of individual sub-moral rights individuals with an indication of illustrative examples are discussed as well as different areas of law where there may be a violation of the rights of individuals. In conclusion, this work is to portray, in which respect the freedom of expression and criticism of politically active people. In this part of the work is to define the concept of freedom of expression, criticism and permissible limits are also given the jurisprudence of the European and U. S. courts.
