Indirect Effect of Directives in Case Law of the ECJ

Abstract:

Anotace: Mezi nástroje sloužící k ochraně práv jednotlivců a zajišťování l’effet utile unijního práva patří i institut nepřímého účinku směrnic. Od rozhodnutí Von Colson, v němž byl tento institut Soudním dvorem poprvé konstatován, až do současnosti, prodělal nepřímý účinek směrnic řadu změn a právě zachycení tohoto vývoje je jedním z témat této diplomové práce. Část textu je rovněž věnována rozboru vztahu nepřímého účinku směrnic vůči účinku přímému a institutu odpovědnosti státu za škodu způsobenou jednotlivci porušením unijního práva. Analýze jsou dále podrobeny i věcné meze, časové omezení a objekt eurokonformní interpretace. Opomíjena není ani otázka, zda je tento institut uplatňován i českými soudy, či jaký je jeho vztah k pojmům „nepřímý účinek v širším pojetí“ a zeslabený nepřímý účinek“. Rovněž otázka spojení nepřímého účinku s dalšími akty (vedle směrnice) unijního práva, není zapomenuta. Zajímavostí doplňující hlavní téma je pak pohled na otázku souladného výkladu v době před vstupem ČR do Evropské unie. Všechny výše uvedené otázky jsou přitom řešeny v kontextu aktuálních změn ve fungování Evropské unie představované Lisabonskou smlouvou, jež vstoupila v platnost 1. 12. 2009.

Abstract:

Abstract: Institute of indirect effect of Directives belongs to set of tools serving to protect individual’s rights and to support l’effet utile of Union Law. It underwent many changes since the Von Colson case, in which the ECJ laid foundation of this institute, up till the present day and capturing this progress represents one of the topics of this project. Attention is paid to analysis of relationship between indirect effect of Directives on one side and the direct effect of Directives and liability of the Member State for damages caused to an individual by breach of the Union Law on the other. Material limits, time restriction and object of consistent interpretation are pertinent to the analysis. Question of whether the institute is applied by Czech courts is answered. Relation between the institute and terms of indirect effect in wider conception and attenuate indirect effect are examined. Connection of indirect effect with other acts (beside Directives) of Union law is probed. Further interesting point which complements the main theme of the project is look at the question of consistent interpretation before admission of the Czech Republic to European Union. All of the questions above are answered in the context of current changes to the functioning of European Union, which are consequent of the Treaty of Lisbon coming into force on the 1st of December 2009.
