The impact of insolvency on creditors

Abstract:

Předmětem práce je dopad insolvence na vybraného věřitele. Na konkrétním příkladu jednoho z největších insolvenčního řízení, které doposud proběhlo na území České republiky, je objasněn vliv tohoto řízení na jednoho ze zúčastněných věřitelů. V teoretické části práce je popsáno podnikání jako takové, charakterizován podnik a jednotlivé fáze jeho životního cyklu, právní úprava insolvence a možnosti jejího řešení. Jsou vysvětleny některé základní pojmy související s insolvenčním řízením. Teoreticky je zde také popsán nástroj sloužící jako zdroj informací o celkové finanční a ekonomické situaci podniku finanční analýza, její metody a ukazatele. Praktická část práce je zaměřena na konkrétní insolvenční řízení a jeho účastníky, tedy dlužníka, společnost PILSEN STEEL s.r.o., a vybraného věřitele, společnost ALFA KOVO, s.r.o. Tato část práce zahrnuje popis situace v obou společnostech z pohledu finanční analýzy, uvádí důvody vzniku insolvence dlužníka, popisuje průběh insolvenčního řízení a jeho výsledek a vliv na společnost ALFA KOVO, s.r.o. V závěru práce je uvedeno shrnutí zpracovávaných informací a získaných poznatků.

Abstract:

The topic of this thesis is the impact of insolvency on a creditor. On the example of one of the largest insolvency cases that have so far taken place in the Czech Republic I elucidate the impact of the insolvency process on one of the concerned creditors. The theoretical part of this thesis describes the basics of business, characterizes the firm and its life cycle, discusses the legal specifics of insolvency and options for its resolution, and explains basic terms related to insolvency cases. It also describes financial analysis as a source of information about the overall financial and economic situation of a firm, including the methods and indicators commonly used in financial analysis. The empirical part focuses on a particular insolvency case and its participants; the debtor PILSEN STEEL, ltd., and a selected creditor, ALFA KOVO, ltd. This part of the thesis includes financial analysis of both firms' situation, lists the causes of the debtor's insolvency, and describes the proceedings in the insolvency case and its outcome, as well as the impact on ALFA KOVO, ltd. The conclusion summarizes the examined data and my findings.
