Termination of the verification in criminal proceeding

Abstract:

Ve své diplomové práci řeším ukončení stádia prověřování v trestním řízení. Pro pochopení prověřování a jeho ukončení je potřeba zasadit prověřování do kontextu celého trestního řízení. Zabývám se proto trestním řízením obecně, stručně popisuji stádia trestního řízení a rozvádím základní zásady trestního řízení, především s ohledem aplikace na stádium prověřování. V diplomové práce se zabývám obecnou charakteristikou prověřování, vymezení pojmu,účelu, orgány činnými v tomto stádiu trestního řízení. Zabývám se jednotlivými postupy prověřování, kdy jsem se zabývala především neodkladnými a neopakovatelnými prostředky a operativně pátracími prostředky. V samotném jádru své diplomové práce se zabývám postupy, kterými lze skončit stádium prověřování. Porovnávám současnou právní úpravu s plánovanou rekodifikací trestního řádu a zabývám se komparací platné trestněprocesní úpravy s cizí úpravou.

Abstract:

In my diploma thesis I deal with the termination of the examination stage in criminal proceedings. In order to understand the examination and its completion, it is necessary to place the examination in the context of the entire criminal proceedings. Therefore, I deal with criminal proceedings in general, briefly describe the stages of criminal proceedings and elaborate on the basic principles of criminal proceedings, especially with regard to the application to the stage of examination. In my diploma thesis I deal with general characteristics of screening, definition of the concept, purpose, authorities active in this stage of criminal examination. I deal with particular examinate procedures, where I dealt with urgent and unrepeatable means and operative search means. At the very core of my thesis I deal with the procedures by which the stage of examination can be ended. I compare the current legislation with the planned recodification of the Code of Criminal Procedure and compare the current criminal procedure with foreign legislation.
