Default interest as legal conseqvence of breach of commitments

Abstract:

The aim of the bachelor thesis is to show the real state of the application of default interest in practice. The bachelor thesis is divided into five chapters. The first chapter deals with breach of trade commitments and its consequences. The second chapter is devoted to the legislation of the default interest in commercial law. The third chapter analyzes and evaluates the application of default interest in practice. The fourth chapter is devoted to the conceptual definition of the sales agreement and process of conclusion of this agreement. The fifth and final chapter analyzes the Micro-loan program, defines the loan agreement and the process to its conclusion. The conclusion points to the necessity to reform the legislation in regard to enforcement of claims by creditors and the need to increase their effectiveness. In the first two chapters is mainly used the theoretical method. In the chapters three, four and five is mainly used the method of analysis.

Abstract:

Cieľom bakalárskej práce je poukázať na skutočný stav uplatňovania úrokov z omeškania v praxi. Bakalárska práca je rozdelená do piatich kapitol. Prvá kapitola sa zaoberá porušovaním obchodných záväzkov a jeho dôsledkami. Druhá kapitola je venovaná pojmu právnej úpravy úrokov z omeškania v obchodnom práve. Tretia kapitola analyzuje a vyhodnocuje uplatnenie úrokov z omeškania v praxi. Štvrtá kapitola je venovaná pojmovému vymedzeniu kúpnej zmluvy a priebehu uzavretia tejto zmluvy. Piata a záverečná kapitola analyzuje mikropôžickový program, vymedzuje pojem zmluvy o úvere a priebeh jej uzavretia. Záver poukazuje na nutnosť reformy právnych predpisov týkajúcich sa vymáhateľnosti pohľadávok zo strany veriteľa a potrebu zvýšenia ich účinnosti. V prvých dvoch kapitolách sa používa predovšetkým teoretická metóda. V kapitolách tri, štyri a päť sa používa predovšetkým metóda analýzy.
