Catalonia and the right of peoples to self-determination.

Abstract:

Práce odpovídá na otázku, zda z mezinárodního práva plyne Katalánsku právo na sebeurčení, a pokud ano, zda má na jeho základě Katalánsko právo na vlastní stát. Po seznámení čtenáře s Katalánskem, jeho historií a kulturou autor poskytuje základní informace o zakotvení katalánské autonomie ve vnitrostátním právu. Následně je přistoupeno k analýze pramenů mezinárodního práva, v nichž je právo na sebeurčení zakotveno, především mezinárodních smluv a obyčeje. Z ní vyplývá, že Katalánsku náleží právo na sebeurčení, avšak pouze v interní podobě, tedy bez práva na samostatný stát.

Abstract:

This thesis addresses the question of whether, under international law, Catalonia is entitled to self-determination, and if so, whether it warrants the right to independence. A summary of Catalan history and culture is followed by an introduction to Spanish national law and specifically an overview of constitutional framework of Spanish autonomous communities. The author then analyses the sources of international law relevant to the right of peoples to self-determination, paying special attention to international treaties and customary law. The analysis shows that Catalonia is entitled to self-determination, albeit in internal form – that is, without the right to secession.
